Ms. Hoang Thi My (character's name has been changed) learned that Decree 177/2024/ND-CP of the Government stipulates policies for cadres and civil servants who retire until retirement age as follows:
Receive the full salary for positions or salary according to ranks, levels, position allowances, seniority allowances exceeding the framework, seniority allowances, salary retention difference, responsibility allowances for members at all levels (if any) until retirement age.
"In case the commune-level cadres and civil servants who previously held the position of Ward Party Committee Secretary and are now on retirement waiting, will they continue to receive the Party Committee responsibility allowance and seniority allowance for political cadres? I request the Ministry of Home Affairs to provide clear and early guidance for the unit to implement" - Ms. My suggested.
Regarding Ms. My's reflection and recommendation, the Ministry of Home Affairs responded on the Electronic Information Portal.
The Ministry of Home Affairs said that the salary and allowances received during the leave waiting for retirement age for cadres who are not old enough to be re-elected or reappointed are implemented according to the provisions of Clause 2, Article 4 of Decree No. 177/2024/ND-CP as follows:
Receive the full salary for positions or salary according to ranks, levels, position allowances, seniority allowances exceeding the framework, seniority allowances, salary retention difference, responsibility allowances for members at all levels (if any) until retirement age;
The person who is on leave waiting for retirement age and the agency where he/she works shall continue to pay social insurance and health insurance according to the provisions of law;
No salary increase or grade will be implemented during the leave waiting for retirement age. Other regimes such as service regime, phone regime (if any), other allowances other than the allowances specified in Point a, Clause 2 of this Article shall cease to be enjoyed from the month following the month in which the decision on leave is made until retirement age. Other regimes and policies (if any) are implemented according to the Internal Regulations and Regulations of agencies, organizations and units as for retirees;
In case the person on leave waiting for retirement age while working is eligible for regular use of cars, the agency is responsible for arranging a car to pick him up if required to attend meetings, conferences or go to the doctor; if not arranged, payment will be made according to regulations;
In case, after the end of the waiting regime is full of retirement but still not enough years of compulsory social insurance to enjoy pensions, it is allowed to support the one -time social insurance payment for the lack of time (but no more than 30 months) to the retirement fund and death from the salary of social insurance premiums at the month of full pension to implement the retirement regime.
The Ministry of Home Affairs has asked Ms. My to study the above regulation to discuss with the management agency where she works for resolution.
