New guidelines on raising salary levels ahead of schedule when retiring early

The Ministry of Home Affairs has just issued a new guiding document, including content related to raising the salary level ahead of schedule when retiring early.

The Ministry of Home Affairs has just issued Official Letter 1814/BNV-TCBC guiding the implementation of Decree No. 178/2024/ND-CP and Decree No. 67/2025/ND-CP of the Government on policies and regimes for cadres, civil servants, public employees, workers and armed forces in implementing the organizational arrangement of the political system.

In particular, regarding the salary increase before early retirement, according to the provisions of the law on civil servants and public employees, 6 months before the date of retirement for civil servants and public employees, the agency, organization or unit must notify the civil servant and public employee of the retirement date.

Accordingly, the salary increase regime for cadres, civil servants and public employees when there is a retirement notice is stipulated in Circular No. 08/2013/TT-BNV dated July 31, 2013 of the Minister of Home Affairs and is applied to cadres, civil servants and public employees when there is a retirement notice mentioned above.

Therefore, for cadres, civil servants and public employees who retire early as prescribed in Decree No. 178/2024/ND-CP (amended and supplemented in Decree No. 67/2025/ND-CP) are not eligible for early salary increase when there is a retirement notice prescribed in Circular No. 08/2013/TT-BNV.

Cadres, civil servants and public employees who retire early according to the provisions of Decree No. 178/2024/ND-CP (amended and supplemented by Decree No. 67/2025/ND-CP) are not eligible for early salary increase when there is a retirement notice.

Previously, according to Circular No. 08/2013/TT-BNV, the Ministry of Home Affairs stipulated the regime of early salary increase for cadres, civil servants, public employees and workers who have announced retirement as follows:

- Cadres, civil servants, public employees and workers who have announced their retirement, if they meet the 2 criteria (regarding task completion and non-discipline) prescribed in Clause 2, Article 2 of this Circular, have not been ranked in the final salary level in the rank or in the title and from the date of announcement of retirement until the retirement date are still 12 months or less to receive a regular salary increase according to regulations, will be raised by one salary level 12 months before the time prescribed in Point a, Clause 1, Article 2 of this Circular.

- In case cadres, civil servants, public employees and workers are both eligible for early salary increase due to outstanding achievements in performing their duties and are also eligible for early salary increase when there is a retirement notice, cadres, civil servants, public employees and workers will be able to choose one of the two salary increase regimes before the deadline prescribed in Clause 1 and Clause 2 of this Article.
