The Ministry of Justice has just announced documents for the meeting to appraise the draft Decree amending and supplementing a number of articles of Decree No. 29/2023 of the Government on staff streamlining, drafted by the Ministry of Home Affairs.
One of the notable contents in this draft Decree is the policy for part-time workers in villages and residential groups who are redundant due to the arrangement of villages and residential groups, and will retire immediately after the arrangement decision of the competent authority.
Accordingly, for part-time workers in villages and residential groups with an age lower than the retirement age prescribed in Appendix I and Appendix II issued with Decree No. 135/2020, they will enjoy the following benefits:
For people with less than 5 years of work
Receive a one-time allowance equal to 0.8 times the current monthly allowance multiplied by the number of months of work.
Receive a subsidy equal to 1.5 times the current monthly allowance for each year of work.
Receive a subsidy of 3 months of current monthly allowances to find a job;
Receive the compulsory social insurance payment period or receive one-time social insurance according to the provisions of the law on social insurance.
For those who have worked for 5 years or more and have a retirement age of 5 years or less
Receive a one-time allowance equal to 0.8 times the current monthly allowance multiplied by the number of months of early retirement compared to retirement age.
Receive a subsidy equal to 1.5 times the current monthly allowance for each year of work.
Receive a subsidy of 3 months of current monthly allowances to find a job;
Receive the compulsory social insurance payment period or receive one-time social insurance according to the provisions of the law on social insurance.
For those who have worked for 5 years or more and have a lower age of 5 years or more to retirement age
Receive a one-time allowance equal to 0.8 times the current monthly allowance multiplied by 60 months.
Receive a subsidy equal to 1.5 times the current monthly allowance for each year of work.
Receive a subsidy of 3 months of current monthly allowances to find a job;
Receive the compulsory social insurance payment period or receive one-time social insurance according to the provisions of the law on social insurance.
The Ministry of Home Affairs also clearly states the policy for part-time workers in villages and residential groups who are of retirement age according to the provisions of Appendix I and Appendix II issued with Decree No. 135/2020/ND-CP or are receiving pension or unemployment benefits, they will receive a one-time allowance equal to 15 months of current monthly allowances.
In addition, the above subjects are not entitled to the policies specified in Articles 5, 6, 7, and 8 of this Decree.
By the end of 2021, the whole country had 90,508 villages and residential groups. Of which, there are 69,580 villages and 20,928 residential groups.
According to Decree 33/2023/ND-CP, part-time workers in villages and residential groups with no more than 3 positions (including Party cell secretary, village chief or residential group leader, head of the Front Working Committee) are entitled to monthly allowances.
