The Ministry of Home Affairs has just proposed amending and supplementing 4 groups of subjects implementing the staff streamlining policy.

The Ministry of Justice announced documents for the meeting to appraise the draft Decree amending and supplementing a number of articles of Decree No. 29/2023 of the Government on staff streamlining, drafted by the Ministry of Home Affairs.

In the draft Decree, the drafting agency proposed 4 groups of subjects to implement the staff streamlining policy.

The first group, cadres, civil servants, public employees; commune-level cadres, civil servants and people working under labor contracts will apply the same regime and policies as civil servants as those prescribed by the Government, if they fall into one of the following cases:

Surplus due to reviewing and rearranging the organization and personnel according to the decision of the competent authority or surplus due to public service units rearranging the organization and personnel to implement the autonomy mechanism.

Surplus due to restructuring cadres, civil servants, and public employees according to job positions, but cannot arrange or reorganize other jobs or arrange other jobs but individuals voluntarily streamline the payroll and are approved by the agency, organization, or unit directly managing.

Not meeting the training level according to the professional and technical standards prescribed for the job position being held, but not having another suitable job position to arrange and cannot arrange training to standardize in terms of expertise and profession or being assigned by another agency or individual but voluntarily implementing staff streamlining and being approved by the agency, organization or unit directly managing.

In the previous year, adjacent or in the year of streamlining the quality of quality classification at the level of failing to complete the task; In the previous year, it is adjacent to the year or in the year to streamline the quality of the quality, to complete the mission, but the individual voluntarily performs the staff streamlining and is directly managed by the agency, organization and unit.

Cadres, civil servants, and public employees who are leaders and managers who cease to hold positions or titles due to organizational restructuring or restructuring, improving the quality of the leadership and management team according to the decision of the competent authority or the decision of the competent authority to cease holding leadership and management positions, or individuals who voluntarily implement staff streamlining and are approved by the agency, organization, or unit directly managing them.

The second group, people working under labor contracts does not determine the duration of performing professional work in the list of professional title positions and professional title positions shared in public service units according to the Government's regulations due to redundancy due to reorganization or restructuring of unit human resources according to the decision of competent authorities.

The third group, part-time workers at the commune level, will retire immediately from the implementation of the 2-level local government model according to the provisions of the Law on Organization of Local Government.

The fourth group, non-professional workers in villages and residential groups who are redundant due to the arrangement of villages and residential groups will retire immediately from the date of the arrangement decision by the competent authority.
