The Government has just issued Decree No. 170/2024/ND-CP on the organization of urban government in Da Nang, which includes regulations on the number of civil servants working in wards and communes.

This Decree specifically regulates the organization and operation of the District People's Committee and the responsibility regime of the District People's Committee Chairman; the organization and operation of the Ward People's Committee and the responsibility regime of the Ward People's Committee Chairman.

Regulating the election, recruitment, management and use of civil servants working at the District People's Committee and cadres and civil servants working at wards and communes; making estimates, implementing and settling district and ward budgets in Da Nang city.

Organizational structure of the District People's Committee

According to the Decree, the organizational structure of the District People's Committee is implemented according to the provisions of Clause 1, Article 7 of Resolution No. 136/2024/QH15 of the National Assembly on the organization of urban government and piloting a number of specific mechanisms and policies for the development of Da Nang city.

In terms of operating principles, the District People's Committee operates under the headship regime; ensuring the principle of democratic centralism. The Chairman of the District People's Committee decides on matters within the duties and powers of the District People's Committee and the Chairman of the District People's Committee and is responsible for his/her decisions.

The activities of the District People's Committee must satisfy the people, comply with procedures, within assigned authority, in accordance with the provisions of law and the Working Regulations of the District People's Committee.

Organizational structure of the Ward People's Committee

The organizational structure of the Ward People's Committee is implemented according to the provisions of Clause 1, Article 8 of Resolution No. 136/2024/QH15.

Other civil servants of the Ward People's Committee include: Office - statistics; land administration - construction - urban and environment; finance - accounting; justice - civil status; culture - society.

In terms of working principles, the Ward People's Committee operates under the headship regime, ensuring the principle of democratic centralism. The specific tasks and powers of the Ward People's Committee stipulated in Points b, c and g, Clause 3, Article 8 of Resolution No. 136/2024/QH15 must be discussed collectively before the Chairman of the Ward People's Committee decides and is responsible for his/her decision.

Number of cadres and civil servants working in wards and communes

The Decree stipulates that cadres and civil servants working in wards and communes are part of the cadre and civil servant payroll of districts and towns under the city; managed and employed by the People's Committee of districts and towns.

The number of cadres and civil servants working at wards and communes shall comply with Government regulations on the number of cadres and civil servants at the commune level.

Every year, the City People's Committee submits to the City People's Council a decision on the number of cadres and civil servants working in wards and communes for each district of the city.

It must ensure that the total number of cadres and civil servants working in wards and communes in districts does not exceed the total number of cadres and civil servants working in wards and communes for the entire city according to legal regulations.

This Decree takes effect from January 1, 2025.
