On January 30, the Government Inspectorate issued Notice No. 253/TB-TTCP Announcing the Inspection Conclusion on the management and use of land and the management of exploration, surveying, planning, licensing, exploitation, and transportation for construction material (VLXD) mines at Cao Bang Provincial People's Committee.
In this notice, the Government Inspectorate said that regarding the licensing of exploration and exploitation of building materials minerals, the compliance with regulations in exploitation activities still has a situation where some units have not seriously fully implemented legal regulations, and there are still cases of exploitation exceeding boundaries and capacity according to the Mining License; not fully storing dossiers, documents, books, and vouchers, not installing weigh stations and cameras as a basis for determining actual mined mineral output; periodic reporting and inventory of mineral reserves are not of guaranteed quality.
However, the annual inspection and examination work of departments and sectors is still not timely in detecting organizations and individuals with signs of violations in mineral exploitation activities in the area to propose handling.
For the above-mentioned shortcomings, omissions, and limitations to occur, the responsibility lies with the Provincial People's Committee, the Department of Natural Resources and Environment (now the Department of Agriculture and Environment); relevant departments, branches, units and district-level People's Committees" - The Government Inspectorate's Notice clearly stated.
Notably, for 12 direct inspection projects, the Government Inspectorate clearly pointed out:
2 projects, at the time the Provincial People's Committee issued the Investment Certificate, approved the investment policy, have not carried out procedures for appraising land use needs; the content of the appraisal document to serve as a basis for approving the investment policy is still incomplete: Project to exploit and process sand, gravel, and gravel for construction materials in Mo Sat hamlet, Ban Ma hamlet, Dan Chu commune, Hoa An district; Project to build a project to exploit and process sand and gravel minerals in the Bang Giang riverbed, Be Trieu commune, Hong Viet commune, Hoa An district.
2 projects, the implementation progress is still slow, not ensuring compliance with the scale of area according to the Investment Policy Approval Decision: Na Chao limestone mine project, Soc Ha commune, Ha Quang district; Ban Cha limestone mine project, Ban Cha hamlet, Ngoc Dao commune, Ha Quang district.
A series of problematic projects
The Government Inspectorate also pointed out that the Ban Cha limestone mine project, Ban Cha hamlet, Ngoc Dao commune, Ha Quang district: the investor used land in the wrong area according to the Investment Certificate.
Ban Tin - Lung Tao limestone mine project in Hanh Phuc commune, Quang Hoa district: no trees are planted around the mining area, wastewater drainage ditches.
Mineral exploitation project for building materials for Ly Quoc stone mine, Ly Quoc commune, Ha Lang district: no environmental permit, permit to use explosives without clearly stating the amount of explosives in one use, detonation control method, safe distance, and time of blasting.
Project of mining and processing sand, gravel, and gravel for building materials in Mo Sat hamlet, Ban Ma hamlet, Dan Chu commune, Hoa An district: the waste storage yard construction item is not included in the environmental impact assessment report, not included in the mine design; not consulting state management agencies on the contents of inland waterways, disaster prevention, dykes, and irrigation before issuing the Mining License; the investor has not organized the acceptance of the completed project, and has not been approved by the competent State agency for the acceptance results before putting it into operation. The investor uses land in the wrong area according to the Investment Certificate and Mining License.
Project of mining and processing sand and gravel minerals in the Bang Giang riverbed, Be Trieu commune, Hong Viet commune, Hoa An district: slow approval of environmental restoration and renovation plan, failure to carry out environmental permit procedures; The investor has not installed a weighing station, opened a monitoring book, and statistically analyzed the exploitation volume.
