The Government Inspectorate has just issued Notice No. 3496/TB-TTCP Announcing the Inspection Conclusion of projects facing difficulties and obstacles in Khanh Hoa province.
In which, the Government Inspectorate pointed out the shortcomings and violations in the Panorama Nha Trang Project (formerly the Ha Quang Trade Center Project) invested by Nha Trang Bay Construction Investment Joint Stock Company. The project was completed in 2019 and put into operation and exploitation.
The Government Inspectorate determined that specialized agencies under the People's Committee of Khanh Hoa province, Nha Trang City People's Committee did not implement the preparation of a plan to rearrange and handle houses and land at No. 02 Nguyen Thi Minh Khai, Loc Tho ward, Nha Trang City, and sent it to the Department of Finance for appraisal to report to the Provincial People's Committee before assigning Nha Trang Bay Construction Investment Co., Ltd. to lease land to implement the Panorama Nha Trang Project, which is not in accordance with regulations.
The Provincial People's Committee leasing land to Nha Trang Bay Construction Investment Co., Ltd. to implement the Project without auctioning land use rights is a violation of regulations.
The project has not yet determined land prices to determine the investor's financial obligations when adjusting the detailed construction plan at a scale of 1/500 (increasing floors from 39 floors to 40 floors).
Notably, the Inspectorate clearly pointed out that the investor's signing of a contract to sell 13 commercial and service apartments to customers was not in accordance with the project's objectives approved in Decision No. 653/QD-UBND dated March 8, 2018 (Project objective: building a commercial center, hotel and tourist apartment, without commercial and service apartments).
The Department of Construction has not fully fulfilled its responsibilities in advising, appraising, issuing, and adjusting construction permits.
Responsibility for the above-mentioned shortcomings, limitations, and violations belongs to the Provincial People's Committee, the Department of Planning and Investment, the Department of Finance, the Department of Natural Resources and Environment, the Department of Construction of Khanh Hoa province, Saigon Real Estate Valuation Co., Ltd., organizations and individuals in each relevant period and the Investor" - the Inspection Conclusion Notice stated.
The Government Inspectorate proposed that the Provincial People's Committee and the Chairman of Khanh Hoa Provincial People's Committee, according to their functions, tasks, and authority, inspect and review the appraisal and approval of specific land prices to calculate land use fees for the project (due to the implementation of the Direct Comparison Method not in accordance with regulations), ensuring correct and sufficient collection, avoiding loss to the state budget; direct the professional agency of the Province to re-determine land prices to determine the investor's financial obligations when changing the detailed construction plan at a scale of 1/500.
The Inspectorate also proposed to direct the inspection and review of 13 tourist apartments that investors have signed purchase and sale contracts with customers for commercial and service purposes to have handling measures, ensuring suitability of project objectives and the rights of third parties.
