The Government Inspectorate has just issued Notice No. 3439/TB-TTCP Announcing the Inspection Conclusion of projects with difficulties and obstacles under the management of the Ministry of Industry and Trade.
In which, the Na Duong II Thermal Power Plant Project is a group A project, level II project; construction location in Na Duong town and San Vien commune, Loc Binh district, Lang Son province (old) invested by Power Corporation - TKV, now Power Corporation TKV - JSC.
The total investment of the Project is 4,088,928,320 million VND, equivalent to 175.754 million USD (cost of 23.265 VND/USD).
Through inspection, the Government Inspectorate determined that during the investment preparation phase, the Investor did not submit the project investment policy dossier to the Department of Planning and Investment of Lang Son province for appraisal and submission to the Provincial People's Committee for decision.
The investor's organization of investment project preparation and appraisal with a prolonged time (30 months behind the Project Investment Preparation Phase Bidding Plan) is one of the reasons leading to the slow commissioning of the Project according to the Power Plan.
The investor approved the total investment of the Project, in which the price of the main equipment of the factory and the item of specialized installation materials costs are unfounded, not in accordance with the regulations on establishing the total investment for imported equipment, which is a violation of regulations.
In addition, Loc Binh District People's Committee (old), Loc Binh District Land Development Center (old), Department of Natural Resources and Environment (old), San Vien Commune People's Committee (old), Na Duong Town People's Committee (old) handed over land to the Investor when Lang Son Provincial People's Committee had not made a decision to allocate land or lease land, which is a violation of regulations.
The investor's failure to prepare and approve the construction design tasks of the Project is a violation of the provisions of Clause 1, Article 32 of Decree No. 15/2021/ND-CP of the Government; approving the construction design of the Project but not calculating and designing the waste area (discharge area, waste floors, safety-enhancing works, environment...) to store the amount of ash and slag generated by the Plant is a violation of Point 3, Section III, Article 1 of Decision No. 452/QD-TTg dated April 12, 2017 of the Prime Minister.
Regarding the shortcomings, defects, and violations of the project, the Government Inspectorate determined that responsibility belongs to the Provincial People's Committee, Department of Planning and Investment (old), Department of Natural Resources and Environment (old), Department of Construction (old), Loc Binh District People's Committee (old), Loc Binh District Land Development Center (old), Lang Son province; Electricity Corporation - TKV...
The Government Inspectorate proposed that the Ministry of Industry and Trade strengthen inspection, supervision, and promptly handle existing shortcomings, defects, and violations in the appraisal, approval, implementation, and implementation of the Na Duong II Thermal Power Plant project.
In addition, the Government Inspectorate proposed that the Provincial People's Committee and the Chairman of Lang Son Provincial People's Committee organize and direct the implementation of self-criticism and handling of responsibilities according to regulations for collectives, individuals, organizations, and units in each period related to shortcomings, defects, and violations in the implementation of the Na Duong II Thermal Power Plant Project mentioned in the Inspection Conclusion.
Directing consideration and handling according to the provisions of law for the violation of "Not establishing design tasks for the construction of Na Duong II Thermal Power Plant" of TKV - CTSR Power Corporation.
The Provincial People's Committee and the Chairman of Lang Son Provincial People's Committee were also proposed to direct relevant agencies, organizations, and units to focus on handling and thoroughly overcoming the shortcomings, defects, and violations mentioned in the Inspection Conclusion; during the implementation process, if signs of criminal law violations are detected, they should be transferred to functional agencies for consideration and handling according to regulations.
