The Law on Organization of Local Government, effective from March 1, 2025, clearly states the duties and powers of the People's Committee at the commune level in Article 22.
Accordingly, the People's Committee of the commune shall develop and submit to the People's Council (PC) of the same level for consideration and issuance of a resolution to perform the tasks and powers according to regulations, including:
Decide on measures to ensure the implementation of the Constitution and laws in the area; Decide on State budget revenue estimates in the area; local budget revenue and expenditure estimates and allocate budget estimates for each other;
Adjust local budget estimates if necessary; approve local budget settlements;
Decide on measures for socio-economic development, ensuring the implementation of national defense, security, social order and safety tasks;
Measures to protect the assets of agencies and organizations, protect the lives, freedom, honor, dignity, assets, other legitimate rights and interests of citizens, ensure human rights, prevent and combat corruption, negativity, waste, prevent and combat crimes and other violations of the law in the area according to the provisions of law;
Decide on policies and measures for the construction of infrastructure and public works in the area according to the provisions of law;
Considering and giving opinions on the establishment, dissolution, merger, division of administrative units, adjustment of boundaries and renaming of administrative units at each level;
At the same time, organize the implementation of the Constitution and laws in localities; organize the implementation of resolutions of People's Councils at the same level; ensure conditions on facilities, human resources and other resources to implement the Constitution and laws in the area;
Implement state administrative management in the area to ensure unity, smoothness, continuity, effectiveness, efficiency, democracy, rule of law, professionalism, modern, clean, public, transparent governance, serving the people;
Issue Working Regulations of People's Committees at their levels; Issue, abolish, amend and supplement documents issued by them when found to be no longer appropriate or illegal;
Perform the assigned tasks and powers, delegated authority and other tasks and powers according to the provisions of law.
Clause 2, Article 22 of the Law on Organization of Local Government 2025 also stipulates the duties and powers of the People's Committee of the town.
Accordingly, the People's Committee of the town performs the same duties and powers as the People's Committee of the commune. At the same time, it added the task of developing and submitting to the People's Councils at the same level for consideration and issuance of a Resolution to carry out 2 tasks and powers such as:
Decide on measures to implement planning and develop towns according to the provisions of law;
Decide on measures to build a civilized urban lifestyle and manage urban residents according to the provisions of law.
