Starting from March 1, 2025, the Law on Organization of Local Government in 2025 officially takes effect.
The Law on Organization of Local Government has many new regulations on organizing the apparatus, decentralization, delegation of power, and delegation of authority, aiming to promote local proactiveness and creativity according to the motto "locality decides, locality does, locality is responsible"; "to the extent the solution is more effective, tasks and authority will be assigned to that level".
Article 23 stipulates the duties and powers of the Chairman of the People's Committee (PC) at the commune level.
Accordingly, the Chairman of the Commune People's Committee performs the following duties and powers:
Lead and manage the work of the People's Committee; convene and chair meetings of the People's Committee;
Lead and direct the implementation of tasks of implementing the Constitution, laws, documents of superior state agencies and of People's Councils and People's Committees at their level; inspect and handle violations in the process of implementing the Constitution and laws in the area;
Lead and be responsible for the operation of the state administrative apparatus, ensure the unity and smoothness of the administrative system; for implementing administrative reform in the area; decide to temporarily suspend the work of the Vice Chairman of the People's Committee at his/her level and the leaders and managers under his/her management and operation;
Perform the task of socio-economic development, protecting the assets of agencies and organizations, protecting human rights and civil rights; ensuring security, order, social safety, preventing and combating corruption, negativity, waste, preventing and combating crimes and other violations of the law in the area according to the provisions of law and decentralizing and authorizing the superior state agency;
Direct, manage, and effectively organize the use of facilities, finances, and state budget sources allocated in the area in accordance with the provisions of law;
Implement the work of receiving citizens, handling complaints and denunciations, preventing and combating bureaucracy, corruption, negativity and waste in the activities of local governments at their level and in socio-economic activities in the area;
Direct and promptly handle emergency situations related to natural disasters, storms, floods, and epidemics in the area;
Guiding and inspecting self-management activities of the village;
Issue, abolish, amend and supplement documents issued by itself when found to be no longer suitable or illegal;
Perform the assigned tasks and powers, delegated authority and other tasks and powers according to the provisions of law.
Also according to the provisions of law, for the Chairman of the Town People's Committee, perform the duties and powers specified in Points a, b, c, d, dd, e, g, i and k, Clause 1 of this Article and the following duties and powers:
Direct and organize the implementation of town planning and development plans in accordance with the provisions of law;
Perform the task of managing urban population; preventing and combating social evils in urban areas; building a civilized urban lifestyle according to the provisions of law;
Perform the task of managing, protecting urban space, architecture and landscape; organize and direct the implementation of tasks to ensure public order and traffic safety in the town according to the provisions of law;
Guiding and inspecting self-management activities of residential groups.
As for the Chairman of the Ward People's Committee performing the duties and powers specified in Points a, b, c, d, dd, e, g, i and k, Clause 1 of this Article, Points b, c and d, Clause 2 of this Article.
