The Minister of National Defense issued Circular No. 25/2025/TT-BQP guiding the implementation of a number of articles of Decree No. 21/2009/ND-CP on regimes and policies for officers who stop serving in the army; officers in active service who died or passed away; officers in active service who are transferred to professional soldiers or defense civil servants, amended and supplemented a number of articles in Decree No. 52/2025/ND-CP dated March 1, 2025.
According to Circular 25/2025, working time to calculate the regime is guided as follows:
The working time to calculate the one-time allowance regime prescribed in Point b, Clause 2, Article 2, Point b, Clause 1, Article 5, Article 7 of Decree No. 21/2009/ND-CP and Point d, Clause 1, Article 4, Clause 2, Article 6, Clause 1, Article 7 of this Circular is the total working time in the Army (including the time as an officer, professional soldier, non-commissioned officer, soldier, defense civil servant, defense worker, defense official) and working time at agencies and units receiving salaries from the state budget with social insurance contributions.
The working time to calculate the conversion prescribed in Clause 1, Article 9 of Decree No. 21/2009/ND-CP, amended and supplemented in Clause 6, Article 1 of Decree No. 52/2025/ND-CP and Clause 1, Clause 2, Article 8 of this Circular to enjoy the one-time allowance regime is the total working time in the Army (including time as an officer, professional soldier, non-commissioned officer, soldier, defense civil servant, defense worker, defense officer) who directly participates in combat, combat service or works in a difficult area or does a job or job classified as heavy, toxic, dangerous working conditions and especially heavy, toxic, dangerous, dangerous work.
The time of guidance work in Point a, Point b of this Clause if interrupted without receiving a one-time allowance (rehabilitation, discharge, termination of employment) will be accumulated.
In case the working time, the additional time due to conversion and the early retirement period have odd months, it will be calculated according to the principle: Less than 3 months are not counted, from 3 months to 6 months are counted as 1/2 year, from more than 6 months to less than 12 months are counted as 1 year.
