On the afternoon of November 17, the National Assembly discussed the draft Law amending and supplementing a number of articles of the Law on Judicial Records (LLTP).
Delegate Nguyen Minh Tam (Quang Tri Delegation) pointed out the reality that many agencies and organizations require individuals to provide criminal records No. 2 for use in purposes such as proving their criminal record to submit applications for employment, study abroad, and settlement.
To avoid abuse, the delegate suggested that the drafting agency remove the regulation on granting LLTP No. 2 in the law.
On the other hand, according to the provisions of the Penal Code, a person whose criminal record has been cleared is considered not yet convicted. The determination of the individual's criminal record should only stop at confirming whether there is a criminal record or not.

Delegate Dong Ngoc Ba (Gia Lai Delegation) proposed that the law adds strict regulations for both LLTP No. 1 and No. 2 ballots.
It clearly stipulates criteria and bases such as those related to social order and safety; occupations directly affecting children and disadvantaged people; financial management... with high risks related to personal identity, new regulations needing legal documents and judicial information.

General Luong Tam Quang - Politburo member, Minister of Public Security said that the drafting agency will study and revise the draft law in the direction of the purpose of managing LLTP information to help citizens know about their LLTP information to resolve personal administrative procedures.
The purpose may also be to support the recruitment of civil servants and public employees to reduce the situation of LLTP requirements in personnel management.
Regarding the right to request the issuance of LLTP cards and the right to request the provision of LLTP information, the drafting agency will study and revise the draft law in the direction that agencies and organizations are not allowed to request citizens to provide LLTP cards No. 2.
This is to ensure the reintegration of people who have completed their prison sentences. At the same time, to ensure the confidentiality of citizens' private lives and minimize the recent spread of LLTP No. 2 requests.
In addition, the draft law has added provisions allowing state agencies, political organizations, and the Vietnam Fatherland Front to exploit LLTP information upon request.
This exploitation is done through connecting and sharing data from the LLTP Database and the National Population Database. The purpose is to support the management of cadres, civil servants and public employees.
Regarding LLTP No. 1 and No. 2 forms and electronic LLTP forms, the drafting agency will study and revise the draft in the direction that citizens' LLTP information is updated and displayed on VNeID.
LLTP information displayed on VNeID is as valid as an LLTP form. This information is applied with security technology to prevent counterfeiting
As soon as VNeID has all information fields fully updated, the Ministry of Public Security will propose to the National Assembly to abolish the Law on Law on Bankruptcy.
