The Government issued Resolution No. 223/NQ-CP at a thematic meeting on law-making in July 2025.
Regarding the draft Law amending and supplementing a number of articles of the Law on Judicial Records, the Government assigned the Ministry of Public Security to preside over and coordinate with ministries and branches to continue to complete the draft Law amending and supplementing the Law on Judicial Records.
The draft law needs to fully institutionalize the Party's policies and procedures, comprehensively innovate policies and procedures in judicial records. Effectively apply technology to build a centralized database system, interconnected with national population data.
The provisions in the draft Law must be transparent, feasible, overcome shortcomings, ensure administrative procedure reform, and not cause inconvenience to people and businesses.
Strengthen decentralization, assign responsibility to leaders, and have a mechanism to monitor law enforcement. The transitional provisions must be clear, avoiding legal gaps.
Regarding the issue of issuing criminal records for commercial entities, the Ministry of Public Security continues to study and refer to international experience to apply in accordance with Vietnamese practice.
According to the proposed draft law, the person requesting a judicial record certificate shall submit a declaration requesting a judicial record certificate and attach the following documents:
- Copies of the identification card or citizen identification card or passport of the person granted a criminal record. In case the father, mother, or guardian requests to issue a criminal record to a person under 14 years old, they must only submit a copy of the ID card or citizen ID card or passport of the father, mother, or guardian.
- In case the individual requests to issue a criminal record online, he/she does not have to submit the above documents.
Individuals submit a declaration requesting a criminal record and accompanying documents to the following agencies:
- Vietnamese citizens submit to the Provincial Police Department of permanent residence; in case they do not have a permanent residence, submit to the Provincial Police Department of temporary residence; in case they are residing abroad, submit to the Provincial Police Department of residence before leaving the country;
- Foreigners residing in Vietnam must submit to the Provincial Police Department where they reside; in case they have left Vietnam, they must submit to the Department of Professional records of the Ministry of Public Security.
Individuals can authorize others to carry out procedures to request the issuance of criminal records. The authorization must be made in writing in accordance with the provisions of law; in case the person requesting the issuance of a criminal record is the father, mother, wife, husband, child, or guardian of the person granted the criminal record, no authorization document is required.
The Minister of Public Security shall specify in detail the order, procedures and application form requiring the issuance of a criminal record.
Previously, the Ministry of Justice held a conference to hand over and receive the task of state management of criminal records and perform public services for issuing criminal records from the Ministry of Justice to the Ministry of Public Security.
The task of criminal records will be officially implemented by the Ministry of Public Security from March 1, 2025. The goal of the Ministry of Public Security in the coming time is to organize the issuance of complete criminal records, 100% online on VNeID to create the best conditions for people.
