In litigation activities, witnesses and witnesses play an important role in providing information, confirming events, and helping competent authorities make accurate decisions.
The newly issued Decree No. 204/2025/ND-CP has detailed the procedures for making estimates and paying for litigation costs.
Accordingly, the decree stipulates in detail the procedures for advance payment and payment of litigation costs between competent authorities conducting litigation with agencies, organizations and individuals conducting litigation activities, including: costs for witnesses, witnesses, translators, interpreters, etc.
The Decree stipulates that after finishing the work of witnessing, witnessing, translating, and translating, the witness, witness, interpreter, and interpreter must send the payment request dossier to the competent authority to conduct litigation in one of the following forms via the postal service, submit directly or online in the electronic environment if meeting the conditions on infrastructure and techniques to carry out payment procedures.
The dossier requesting payment of costs for witnesses, witnesses, interpreters, and interpreters includes:
Proposal to pay costs to witnesses, witnesses, interpreters, and interpreters according to Form No. 01 issued with this Decree.
The documents accompanying the payment request are the original copies of relevant legal invoices and documents to prove the necessary and reasonable costs incurred that the witness, witness, interpreter, or interpreter has paid when coming to witness, witness, interpret, or translate according to regulations.
In case the dossier requesting payment of costs to witnesses, witnesses, interpreters, and interpreters is not complete and valid, within 03 days from the date of receipt of the dossier, the competent authority conducting the litigation must notify the witness, witness, interpreter, and interpreter and clearly state the reason for supplementing the dossier according to regulations.
Within 10 days from the date of receipt of a complete and valid payment request, the competent authority shall conduct a litigation to pay the costs to witnesses, witnesses, interpreters, and interpreters.
This Decree takes effect from July 11, 2025.
