Prime Minister Pham Minh Chinh has just signed Official Dispatch No. 08/CD-TTg dated February 3, 2026 on focusing on removing difficulties and obstacles in organizing the implementation of Decree No. 46/2026/ND-CP of the Government detailing the implementation of a number of articles and measures to organize and guide the implementation of the Law on Food Safety.
The Prime Minister requests the Ministry of Health, the Ministry of Agriculture and Environment, the Ministry of Industry and Trade and relevant ministries and agencies to urgently direct and issue documents guiding the implementation of Decree No. 46/2026/ND-CP dated January 26, 2026 on inspecting food and import-export goods according to their functions, tasks, authority, and assigned management areas.
At the same time, directing and urging units and localities to fully prepare facilities, human resources, and equipment to implement, ensuring timely and smooth customs clearance according to regulations, without causing congestion and congestion of food and import and export goods.
The Ministry of Health shall preside over and coordinate with the Ministry of Agriculture and Environment, the Ministry of Industry and Trade, the Ministry of Justice and relevant agencies to urgently review the regulations in Decree No. 46/2026/ND-CP; summarize the implementation situation, difficulties and obstacles, report and propose specific issues at the regular Government meeting in January 2026.
Ministries: Health, Agriculture and Environment, Industry and Trade immediately establish 24/7 hotlines and immediately announce hotline information on mass media; arrange regular on-duty personnel to promptly answer and clarify emerging issues, especially the implementation of new regulations in Decree No. 46/2026/ND-CP and be ready to receive and handle arising problems.
The Ministry of Finance directs the Customs Department to request border gate customs to arrange forces to work 24/7, closely coordinate with functional forces at border gates, urgently relieve congestion, ensure timely customs clearance of food and import and export goods; ensure smooth operation of the electronic customs clearance system during this peak period.
The Ministry of National Defense and the Ministry of Public Security shall perform their functions, tasks, and powers in ensuring sovereignty, security, order, and preventing and combating negativity that may occur in the process of implementing legal regulations on food safety nationwide.
The People's Committees of provinces and cities immediately assign tasks to functional agencies in localities to carry out state inspections of food safety and designate food testing facilities, ensuring that there are sufficient testing facilities to serve state management according to the provisions of Decree No. 46/2026/ND-CP.
Decide according to authority on the application of necessary measures to support enterprises in carrying out state inspection procedures, fully and promptly carry out inspection and testing activities for food and goods imported and exported that are blocked and congested in the area, ensuring fastest customs clearance.
Directing functional forces at border gates to closely coordinate, arrange 24/7 work, rationally distribute traffic flow, prioritize areas for separate gathering of fresh agricultural products and essential food to urgently resolve the situation of congestion in state inspection at some border gates, ensuring timely customs clearance of food and goods for import and export.
In case the dossier is complete according to the commitment, customs clearance must be granted immediately; sample inspection will be carried out in parallel or post-inspection at the enterprise's warehouse.
