The National Assembly has passed the Emergency Situation Law. This Law takes effect from July 1, 2026.
Currently, the Department of Rescue and Relief, General Staff of the Vietnam People's Army is organizing to collect opinions to complete the draft dossier of the Decree detailing a number of articles of the Law on Emergency Situations (TTKC).
The draft Decree states the state management responsibilities for TTKC, including the Ministry of National Defense and the Ministry of Public Security.
Article 13 of the draft Decree stipulates the responsibilities of the Ministry of National Defense.
Accordingly, the Ministry of National Defense is the focal point responsible to the Government for implementing state management of TTKC; presiding over advising the Prime Minister to propose competent authorities to decide to promulgate and abolish TTKC on national defense and TTKC on disasters caused by earthquakes, tsunamis, and oil spills.
Direct subordinate forces to closely coordinate with localities in preventing, responding, and overcoming consequences in TTKC; participate in the production and supply of equipment, supplies and relief for people in areas located in TTKC.
Preside over and coordinate with ministries, ministerial-level agencies, and agencies under the Government to adjust and supplement the Operating Regulations and ensure the operating conditions of the National Steering Committee for Civil Defense in accordance with legal regulations on TTKC.
Using the Office of the National Civil Defense Steering Committee as a specialized agency assisting the Ministry of National Defense and the National Civil Defense Steering Committee, the Command of the TTKC on national defense to perform tasks related to TTKC in accordance with legal regulations.
Preside over and coordinate with central ministries and branches to review legal normative documents, propose amendments and supplements to ensure compliance with the TTKC Law; organize inspections of the implementation of legal normative documents on TTKC.
Coordinate with the Ministry of Finance and central ministries and branches, provincial-level People's Committees to summarize needs and propose to the Prime Minister to decide on emergency disbursement of national reserves to central ministries and branches, and localities in TTKC.
Coordinate with the Ministry of Foreign Affairs, relevant ministries and sectors to submit to the Government on participation in international organizations, signing or participating in international treaties and implementing international activities related to TTKC.
Article 14 of the draft Decree states the responsibility of the Ministry of Public Security.
Accordingly, the Ministry of Public Security presides over advising the Prime Minister to propose to competent authorities to decide to promulgate and abolish TTKC on national security, order, and social safety; TTKC due to major fire disasters in urban areas, industrial parks, and residential areas.
Promulgate according to their authority or submit to competent authorities for promulgation and direction of the implementation of legal normative documents on ensuring security, order, and social safety in TTKC.
Preside over and coordinate with relevant ministries, branches and local authorities or direct the Provincial and City Police to develop plans, schemes and organize the implementation of tasks to protect national security, ensure social order and safety in areas placed in TTKC.
Direct subordinate forces to closely coordinate with relevant forces and localities in preventing, responding, and overcoming consequences in TTKC; participate in the production and supply of equipment, supplies, and relief for people in areas located in TTKC.
