The National Assembly has passed the Emergency Situation Law. This Law takes effect from July 1, 2026.
Currently, the Department of Rescue and Relief, General Staff of the Vietnam People's Army is organizing to collect opinions to complete the draft dossier of the Decree detailing a number of articles of the Emergency Situation Law.
Article 5 of the draft Decree states the regime of insurance, health care and safety assurance for people who are mobilized and mobilized to perform tasks in an emergency situation according to the decision of competent authorities.
Accordingly, people who are mobilized and mobilized to perform tasks in an emergency situation are guaranteed benefits in terms of social insurance, health insurance, occupational accident and disease insurance according to the provisions of law.
Being health checked before, during and after completing tasks when necessary; dispensing medicines, medical supplies and receiving timely medical care when sick, injured, or injured.
In case of accidents, injuries, illnesses or health damage while performing duties, medical examination, treatment, and rehabilitation costs are paid; assessment of the degree of reduced working capacity; enjoying allowances and compensation regimes according to the provisions of law.
In case of death during the performance of duties or due to direct consequences of performing duties, relatives are entitled to preferential regimes and policies according to the provisions of law on people with meritorious services and relevant legal regulations.
Article 6 of the draft Decree mentions the regime of compensation for damages, allowances, rewards and other support for people who are mobilized and mobilized to perform tasks in an emergency situation according to the decision of competent authorities.
Accordingly, people who are mobilized and mobilized to perform tasks in an emergency situation are compensated for damage to legal property damaged or lost due directly to the performance of tasks according to the provisions of law.
In case of impaired working capacity or loss of working capacity due to accidents or illnesses arising during the performance of tasks, a one-time allowance or monthly allowance is considered; support for training and career change suitable to the remaining working capacity.
People who excellently complete tasks and have special achievements in an emergency situation are considered for commendation according to the provisions of law on emulation and commendation.
The State encourages agencies, organizations, and individuals at home and abroad to participate in supporting and contributing resources to care for the material and spiritual life of people who are mobilized and mobilized to perform tasks in emergency situations according to the provisions of law.
