Continuing the program of the 9th Session of the 15th National Assembly, on the morning of May 20, Director of the Supreme People's Procuracy Nguyen Huy Tien presented the draft Law amending and supplementing a number of articles of the Criminal Procedure Code (CPC).
Immediately afterwards, Chairman of the National Assembly's Committee on Law and Justice Hoang Thanh Tung presented a report on the review of the above draft Law.
Presentation of the Law Project before the National Assembly, the Head of the Supreme People's Procuracy Le Minh Tri said that the amendment and supplementation of a number of articles of the CrPC is to improve the legal basis to ensure compliance with the names, authority, tasks and powers of the competent authorities and people in criminal proceedings under the arrangement plan, streamlined the apparatus approved by competent authorities. At the same time, ensure timely solving some urgent issues arising from reality.

Notably, based on the proposal of the Ministry of Public Security, the draft Law has supplemented regulations in the direction of adding authority and tasks for the Chief of Public Security and Deputy Chief of Commune-level Public Security.
Accordingly, an intermediate-level investigator or higher (of the Investigation Police Agency (IPA) - Provincial Police) is the Chief of Police, Deputy Chief of Commune-level Police assigned by the Head of the Provincial Police Investigation Agency, with the authority to prosecute and investigate a criminal case for a crime of less seriousness and seriousness, with the highest penalty of up to 7 years in prison occurring in the commune-level area.
The drafting agency believes that the addition of this regulation is to meet practical requirements when not organizing district-level police.
Regarding the above content, the National Assembly's Law and Justice Committee found that in the context of the post-arrangement of administrative units, many localities are merged on the basis of 2 or 3 current provincial-level administrative units and each locality only has 1 level of Investigation Agency at the provincial-level Police (instead of 2 levels as before).
It is very necessary that the draft Law proposes to add a number of tasks and powers to the Investigator who is the Chief of Commune-level Police (or Deputy Chief of Commune-level Police) similar to the tasks and powers of the Chief of Investigation Agency.

However, according to the Legal and Judicial Committee, the contents of the investigator's tasks and powers are the Chief of the Commune Police Chief of the Commune Police Department) in the Draft Law with many inappropriate content, conflict with other contents of the CrPC and conflicts in the draft law, so they will arise problems and not be tested when deployed in reality.
"The Committee requests the agency to carefully review and carefully review the regulations of the CrPC to amend and supplement the regulations to ensure strict, uniform and feasible to meet the requirements of timely settlement of cases and cases that occur in the commune level," said the Chairman of the National Assembly and Justice Committee of the National Assembly Hoang Thanh Tung.
