The Government has recently issued Decree No. 170/2024/ND-CP on the organization of urban government in Da Nang. This Decree takes effect from January 1, 2025.
The organizational structure of the District People's Committee includes the Chairman of the District People's Committee; Vice Chairman of the District People's Committee; Commander of the District Military Command; Chief of the District Police; specialized agencies under the District People's Committee; other administrative agencies and public service units under the District People's Committee.
The People's Committee of a grade I district has no more than 3 Vice Chairmen, and a grade II district has no more than 2 Vice Chairmen.
The Chairman and Vice Chairman of the District People's Committee are civil servants holding leadership and management positions of the District People's Committee.
The Chairman of the District People's Committee is responsible for implementing the provisions of the Law on Cadres and Civil Servants, leading and directing the activities of the District People's Committee, specialized agencies, and public service units directly under the District People's Committee;
Manage cadres, civil servants and public employees working in districts and wards according to the provisions of law on cadre, civil servants and public employee management and according to the decentralization and authorization of the City People's Committee, Chairman of the City People's Committee...
From the effective date of this Decree, if commune and ward officials and civil servants meet the prescribed standards, they will be transferred to district-level officials and civil servants or higher to work at the ward or commune. In case of transfer to a new job position, officials and civil servants must ensure the conditions and standards appropriate to that job position.
The specialized agency under the district-level People's Committee in the field of internal affairs reviews the records of commune and ward officials and civil servants to report to the Chairman of the district-level People's Committee and sends them to the specialized agency under the city-level People's Committee in the field of internal affairs for appraisal and submission to the Chairman of the city-level People's Committee to issue a decision to transfer ward and commune officials and civil servants to become officials and civil servants under the payroll of the district-level People's Committee or higher to work in wards and communes.
The Chairman and Vice Chairman of the District People's Committee; the Chairman and Vice Chairman of the Ward People's Committee appointed before January 1, 2025 shall continue to perform their duties and powers as prescribed. The term of office shall be calculated according to the appointment decision.
Civil servants working at the Ward People's Committee who were recruited and appointed to the civil service rank before January 1, 2025 will continue to be managed and employed according to the provisions of this Decree.
Commune-level cadres, civil servants and ward cadres who do not meet the prescribed standards must meet the prescribed standards within 3 years from the effective date of this Decree. During this period, they shall continue to implement the regimes and policies currently enjoyed according to the Government's regulations on commune-level cadres, civil servants and part-time workers at the commune level.
After 3 years, if the prescribed standards are not met, retirement will be implemented (if eligible) or the staff reduction policy will be implemented according to Government regulations.
The City People's Committee is responsible for developing a training plan for commune and ward officials and civil servants to meet the standards for officials and civil servants and job requirements.
The time holding positions of officials in Party organizations, People's Councils, People's Committees, Vietnam Fatherland Front Committees and socio-political organizations in wards and communes before the effective date of this Decree shall be counted towards the time holding positions according to regulations.
