On December 5, Ben Tre Provincial People's Council held the 16th session of the 10th term, 2021-2026 term.
At the meeting, reporting on the opinions and recommendations of voters before the meeting, Mr. Nguyen Minh Canh - Vice Chairman of Ben Tre Provincial People's Committee - said that regarding the management of public land in the area, recently, Ben Tre Provincial People's Committee has issued many documents directing the strengthening of land management in the area, especially the management of public land.
Accordingly, the Provincial People's Committee has directed the management of public land, established legal records, and put it under management according to legal regulations. However, in some districts and cities, the management of public land is not strict, encroachment still occurs and has not been handled promptly.
Mr. Canh said that the reason is due to the lack of staff, each commune has one land officer, so it is not timely and regular to check and handle cases of encroachment on public land. Some plots have public land origin (land records are under the name of the Commune People's Committee), however, in the current situation, houses have been formed, many people have lived there since before 1993, so it is necessary to continue to review and identify the correct subjects to carry out registration and issue land use right certificates in accordance with regulations.
"In the coming time, the People's Committee of Ben Tre province will continue to direct the People's Committees at district and commune levels, including the People's Committee of Chau Thanh district, to further strengthen land management in the area, especially the management of public land. Conduct inspections and reviews of public land funds, thereby resolutely handling encroachment cases in accordance with regulations. At the same time, review and thoroughly resolve land plots of public land origin in accordance with regulations" - Mr. Canh said.
According to Inspection Conclusion No. 412 of Ben Tre Provincial Inspectorate, the results of inspection and verification of cases of encroachment and occupation of land managed by the State are 19 plots in Chau Thanh district (Ben Tre province).
In which, An Phuoc Commune People's Committee did not manage land tightly, allowing 2 households to encroach and occupy. Giao Hoa Commune People's Committee (Giao Hoa Commune merged into Giao Long Commune to become Giao Long Commune since 2020) did not manage land tightly, allowing households to encroach and occupy for a long time without taking any measures to handle it. Tien Long Commune People's Committee allowed 2 households to encroach and occupy, then the Commune People's Committee allocated land without authority. Tien Thuy Commune People's Committee did not manage land tightly, allowing 7 households to encroach and occupy.
Thanh Trieu Commune People's Committee lacked responsibility in managing assigned public land, failed to promptly report and propose handling of the case of Mr. Le Van Be's household occupying and using land plots No. 39 and No. 40, along with map sheet No. 14.
The People's Committee of Huu Dinh Commune is still passive in managing the assigned public land, failing to promptly monitor and grasp information on the current status of land use under its management. After the end of the land lease contract for Mr. Nguyen Van Vu and Mr. Nguyen Van Tu, the Department of Natural Resources and Environment did not notify the People's Committee of Huu Dinh Commune to monitor and manage the land. At the same time, it was slow to advise the People's Committee of Chau Thanh District to direct the handling of the case of land encroachment and occupation by Ms. Tran Thi Ri.
Chau Thanh Town People's Committee was assigned to manage public land but in reality it cannot manage or use it because 4 households are living on this land.
