Violations of regulations on allocation and use of public assets are fined up to 20 million VND

The Government stipulates a fine of up to 20 million VND for violations of assigning and using public property, destroying or intentionally damaging public property.

This content is stipulated in Decree No. 55/2026/ND-CP of the Government amending and supplementing many new regulations on sanctioning administrative violations in the field of public asset management.

One of the notable new points of Decree No. 55/2026/ND-CP is the addition of specific regulations on the principle of determining the amount of illegal profits obtained from administrative violations:

The determination of illegal profits is carried out by the person with authority to sanction administrative violations and recorded in the decision to sanction administrative violations or the decision to apply remedial measures.

The amount of illegal profit is determined as follows: For administrative violations that have ended, the amount of illegal profit is determined from the time the organization or individual starts to have an administrative violation to the time the violation ends.

For administrative violations being committed, the amount of illegal profit is determined from the time the organization or individual starts to commit administrative violations to the time the agency or person with authority detects the violation.

In case organizations and individuals commit many administrative violations, the amount of illegal profits obtained according to each administrative violation shall be determined.

At the same time, Decree No. 55/2026/ND-CP also stipulates fines for organizations that purchase assets exceeding the standards and norms prescribed by agencies and competent persons according to the following penalties:

- From 2,000,000 VND to 5,000,000 VND in case of purchasing assets worth more than 50,000,000 VND.

- From 5,000,000 VND to 10,000,000 VND in case of purchasing assets worth more than 50,000,000 VND to less than 75,000,000 VND.

- From 10,000,000 VND to 20,000,000 VND in case of purchasing assets with a value exceeding 75,000,000 VND or more.

Decree No. 55/2026/ND-CP also amends and supplements Article 8 on penalties for violations of regulations on assigning and using public property, destroying or intentionally damaging public property as follows:

A fine of between VND 1,000,000 and VND 5,000 shall be imposed on organizations for one of the following acts: Failing to hand over assets assigned by agencies or competent persons to agencies, organizations, and units for receipt within the prescribed time limit; failing to receive assets assigned by agencies or competent persons from agencies, organizations, and units for receipt within the prescribed time limit.

Fines shall be imposed on organizations that hand over public assets when there is no decision to hand over assets from agencies or competent persons as prescribed by law or hand over public assets to the wrong subjects, types, and quantities according to the decision to hand over assets from agencies or competent persons (calculated on each asset) according to the following penalties:

From VND 2,000,000 to VND 5,000,000 in cases of handing over public assets worth less than VND 50,000,000; from VND 5,000,000 to VND 10,000,000 in cases of handing over public assets worth from VND 50,000,000 to less than VND 75,000,000; from VND 10,000,000 to VND 20,000,000 in cases of handing over public assets worth VND 75,000,000 or more.
