The National Assembly has passed the Deposit Insurance Law. This Law takes effect from May 1, 2026.
This Law stipulates deposit insurance activities; the rights and obligations of depositors, deposit insurance participants, deposit insurance organizations and state management of deposit insurance.
Regarding the principle of handling special loans, the Law stipulates that special loans from deposit insurance organizations are prioritized for repayment according to the provisions of Clause 1, Article 194 of the Law on Credit Institutions.
After the bankruptcy plan is approved, the money specially lent by the deposit insurance organization is converted into a deposit payment to the depositor.
Regarding special loans from the State Bank of Vietnam, according to the Deposit Insurance Law, deposit insurance organizations are entitled to special loans at 0% interest, without collateral from the State Bank of Vietnam in cases specified in Article 21 of this Law and when the amount in the nghiệp vụ contingency fund is not enough to pay insurance money.
The amount of money in the professional reserve fund that is not enough to pay insurance money is determined when the deposit insurance organization has used up the amount of money in the professional reserve fund but is still not enough to fulfill the obligation to pay insurance money.
The sale of unvalid valuable papers and the withdrawal of unvalid deposits must ensure the principle of capital preservation in investment activities.
Deposit insurance organizations develop plans to increase deposit insurance premiums to compensate for special loans; use money to repay special loans of credit institutions, revenue from selling valuable papers held by deposit insurance organizations, from liquidating assets of special loan credit institutions, deposit insurance premiums to prioritize repayment of special loans to the State Bank of Vietnam.
The Governor of the State Bank of Vietnam provides guidance on the State Bank of Vietnam lending to special deposit insurance organizations.
