The Government has issued Decree 106/2025/ND-CP detailing the handling of administrative violations in the fields of fire prevention, fire fighting and rescue. The Decree takes effect from July 1, 2025.
Notably, Decree 106 has added regulations on additional penalties for "limited suspension of operations" for 6 acts with a direct risk of causing fire and explosion, including:
Violating regulations on appraisal of designs and acceptance of fire prevention and fighting (Clause 6, Article 18), accordingly:
Suspend operations from 3 months to 6 months for the act of putting works, construction items, and vehicles that have been approved for design or appraised for fire prevention and fighting into exploitation and use without a document approving the results of fire prevention and fighting acceptance by the specialized management agency.
Suspend operations from 6 months to 12 months for the act of putting works, construction items, and means of transport subject to fire prevention and fighting design appraisal into use and operation without a document appraising the fire prevention and fighting design and a document approving the results of fire prevention and fighting acceptance by a specialized management agency.
Violating regulations on equipment and installation of fire prevention, fighting, rescue and relief equipment (Clause 11, Article 20), accordingly:
Suspend operations from 3 months to 6 months for failure to equip or install a fire alarm system; failure to equip or install a fire fighting system.
Violating regulations on the use of fire prevention, fighting, rescue and relief vehicles (Clause 8, Article 21), accordingly:
Suspend the operation from 1 month to 3 months for the act of not maintaining the operation of the fire alarm system that has been equipped or installed; not maintaining the operation of the fire alarm system that has been equipped or installed.
Violating regulations on ventilation and smoke prevention (Clause 6, Article 23), accordingly:
Suspend operations from 03 months to 06 months for failure to maintain ventilation solutions for areas of production, storage, trading, and use of substances and goods with fire and explosion hazards that have been equipped and installed.
Violating regulations on escape in fire prevention and fighting (Clause 6, Article 24), accordingly:
Suspend operations from 03 months to 06 months for the act of not maintaining escape routes or escape routes of houses and works; not having enough escape routes or escape routes of houses and works.
Violating regulations on fire prevention (Clause 8, Article 25), accordingly:
Suspend operations from 06 months to 12 months for the act of building houses and works that do not ensure a fire prevention and fighting distance.
