The Lao Dong Newspaper Legal Consulting Office replied:
Article 2 of Decree 154/2025/ND-CP (effective from June 16, 2025) stipulates the subjects of the staff streamlining policy as follows:
1. Cadres, civil servants, public employees; commune-level cadres, civil servants and people working under labor contracts are subject to the same regime and policies as civil servants as according to the Government's regulations (hereinafter referred to as workers), if they fall into one of the following cases:
a) Civil servants, public employees and workers redundant due to organizational restructuring (except for subjects enjoying policies and regimes in implementing organizational restructuring of the political system according to separate regulations of the Government);
b) Cadres, civil servants, and public employees who lead or manage and cease holding positions and titles of leadership or management or are appointed or elected to positions and titles of leadership or management with lower salary levels or leadership position allowances due to the arrangement of the apparatus and individuals voluntarily implement staff streamlining and are approved by the agency, organization, or unit directly managing them (except for subjects enjoying policies and regimes in implementing the arrangement of the apparatus of the political system according to specific regulations of the Government);
c) Cadres, civil servants, and public employees who lead or manage to cease holding positions and titles of leadership or management due to restructuring or improving the quality of the leadership and management team according to the decision of the competent authority or the decision of the competent authority to cease holding leadership or management positions, or individuals who voluntarily implement staff streamlining and are approved by the agency, organization, or unit directly managing them;
d) Surplus due to reviewing and rearranging personnel according to the decision of the competent authority or surplus due to public service units rearranging personnel to implement the autonomous mechanism;
d) Surplus due to restructuring cadres, civil servants, and public employees according to job positions, but cannot arrange or reorganize other jobs or arrange other jobs but individuals voluntarily reduce staff and are approved by the agency, organization, or unit directly managing them;
e) Not meeting the training level according to the professional and technical standards prescribed for the job position being held, but not having another suitable job position to arrange and cannot arrange retrainment to standardize the expertise and skills or being assigned by another job agency but the individual voluntarily implements staff streamlining and is approved by the agency, organization or unit directly managing;
g) In the previous year or in the year of implementing the review of staff streamlining to classify quality as not completing tasks associated with performing assigned duties and responsibilities; in the previous year or in the year of implementing the review of staff streamlining to classify quality as completing tasks but individuals voluntarily carry out staff streamlining and are approved by the agency, organization or unit directly managing them;
h) In the previous year or in the year of the staff streamlining review, with the total number of sick leave days equal to or higher than 200 days, with confirmation from the Social Insurance agency to pay sick leave allowances according to current regulations of law; in the previous year or in the year of the staff streamlining review, the total number of sick leave days is equal to or higher than the maximum number of sick leave days according to the provisions of the law on social insurance, with confirmation from the Social Insurance agency to pay sick leave allowances according to current regulations of law, individuals voluntarily carry out staff streamlining and are approved by the agency, organization, or unit directly managing.
2. People working under labor contracts do not determine the duration of performing professional and technical work on the list of professional title positions and professional title positions shared in public service units according to the Government's regulations that are redundant due to the restructuring of the unit's human resources according to the decision of the competent authority or redundant due to the reorganization of the apparatus (except for subjects enjoying policies and regimes in implementing the reorganization of the apparatus of the political system according to the Government's separate regulations).
3. People working under unlimited labor contracts shall perform support and service work in administrative agencies and public service units according to the provisions of law due to redundant organizational apparatus arrangement (except for subjects enjoying policies and regimes in implementing organizational apparatus arrangement of the political system according to separate regulations of the Government).
4. Part-time workers at the commune level will retire immediately from the implementation of the 02 level local government model according to the provisions of the Law on Organization of Local Government.
5. Non-professional workers in villages and residential groups who are redundant due to the arrangement of villages and residential groups will retire immediately after the decision on arrangement is issued by the competent authority.
Thus, people participating in protecting security and order at the grassroots level are not subject to staff streamlining.
