Clause 1, Article 70 of the 2025 Law on Civil Judgment Enforcement (effective from July 1, 2026) stipulates as follows: A judgment debtor who has not completed the obligation to enforce the judgment according to the judgment or decision may be temporarily suspended from leaving the country, except for the following cases:
a) In cases where the person who has to perform monetary and property obligations has sufficient assets to perform the obligation and agrees to let the civil judgment enforcement agency hand over and handle assets for judgment enforcement, and has authorized another person to represent them in resolving judgment enforcement related to those assets;
b) Judgment enforcement obligations have been transferred according to the provisions of this Law;
c) When the judgment debtor is issued an extradition decision by a competent Court according to the provisions of the Extradition Law;
d) Other cases as prescribed by law.
Clause 1, Article 45 of Decree 152/2026/ND-CP (effective from July 1, 2026) stipulates other cases specified in Point d, Clause 1, Article 70 of the 2025 Law on Civil Judgment Enforcement, including:
a) Having grounds not to be temporarily suspended from exiting the country according to the provisions of law on entry and exit;
b) Being a foreigner who committed a less serious crime and is suffering from a serious illness or does not have assets or income in Vietnam, and has a commitment to fulfill obligations after returning home.
The commitment form must have confirmation from the diplomatic mission in Vietnam of the country of which the person has nationality regarding urging that person to fulfill the obligation to enforce the collection and payment to the state budget according to the provisions of Vietnamese law;
c) Having a document from the police agency or diplomatic representative agency requesting exit in cases where an individual who commits a serious, very serious, especially serious crime is suffering from a serious illness or has no assets or income in Vietnam but is not allowed to exit the country by the judgment creditor or cannot identify the address of the judgment creditor or the judgment creditor is a foreigner who has returned to the country and other special cases.
Thus, from July 1, 2026, the above cases will not be temporarily suspended from leaving the country for civil judgment enforcement.
