Cases where foreigners are not granted a Housing Certificate

The Lao Dong Newspaper Legal Consulting Office replied:

Article 22 of the 2023 Housing Law stipulates the following cases of foreign organizations and individuals not granted a Certificate for housing:

1. Foreign organizations and individuals falling under the following cases are not granted a Certificate for houses but are only allowed to sell or donate these houses to subjects who are allowed to own houses in Vietnam:

a) Foreign organizations and individuals who are granted or inherited houses not falling under the provisions of Point b, Clause 2, Article 17 of this Law or exceeding the number of houses permitted to be owned as prescribed in Article 19 of this Law or in areas requiring national defense and security as prescribed in Article 16 of this Law;

b) Foreign organizations not operating in Vietnam, foreign individuals are not allowed to enter Vietnam but are granted or inherited housing in Vietnam.

2. The subjects specified in Point a, Clause 1 of this Article are directly or authorized to sell or donate houses to other organizations and individuals; the subjects specified in Point b, Clause 1 of this Article are authorized to sell or donate houses to other organizations and individuals residing or operating in Vietnam.

3. The subjects eligible to inherit houses with both organizations and individuals who are eligible to own houses and are not eligible to own houses in Vietnam must agree to handle the inherited assets of this house in one of the following cases:

a) To allow organizations and individuals who are eligible to own houses in Vietnam to inherit this house; organizations and individuals who are not eligible to own houses in Vietnam to enjoy the value of this house corresponding to the inherited assets;

b) Giving or selling this house to an organization or individual eligible to own a house in Vietnam to enjoy the value.

Thus, in the above cases, foreign individuals are not granted a Certificate of Housing in Vietnam.
