The Lao Dong Newspaper Legal Consulting Office replied:
Article 75 of the Law on Social Insurance 2024 (effective from July 1, 2025) stipulates the temporary suspension, termination, and continued receipt of monthly pensions and social insurance benefits as follows:
1. Temporarily suspend receiving monthly pension and social insurance benefits for beneficiaries in one of the following cases:
a) Illegal exit;
b) Declared missing by the Court;
c) When the beneficiary's information cannot be verified as prescribed in Point c, Clause 2, Article 11 of this Law.
2. End the monthly pension and social insurance benefits for beneficiaries in one of the following cases:
a) Death or being declared dead by the Court;
b) Reject to receive monthly pension and social insurance benefits in writing;
c) Conclusion of competent authority on social insurance benefits not in accordance with the provisions of law.
3. The monthly pension and social insurance benefits of the subjects specified in Clause 1 and Point a, Clause 2 of this Article shall continue to be paid, including the pension and monthly social insurance benefits for the period not yet received when falling into one of the following cases:
a) People illegally leaving the country returning;
b) Having a decision of the Court to cancel the decision to declare him missing or the decision to declare him dead;
c) The subject specified in Point c, Clause 1 of this Article has verified the information as prescribed in Point c, Clause 2, Article 11 of this Law.
4. Pension and monthly social insurance allowance of the subject specified at Point b, Clause 2 of this Article will continue to pay from the time the social insurance agency receives a written request to re -enjoy the monthly pension and social insurance allowance and excluding the monthly pension and social insurance allowance of the unpopular time due to the refusal.
Thus, the above cases will have their monthly pension suspended.
