A reader with email thucphamxxx@gmail.com asked: What benefits do civil servants who are on active duty at commune-level facilities enjoy?

The Lao Dong Newspaper Legal Consulting Office replied:

Clause 1, Article 12 of Decree 178/2024/ND-CP stipulates that for cadres, civil servants, and public employees who are assigned to work at Party, State agencies and socio-political organizations at the commune level, they are entitled to the following regimes:

a) Continue to receive salary (including salary allowances) according to job position before being sent by agency, organization or unit.

b) One-time allowance equal to 10 months of basic salary at the time of receiving the job.

c) In case the unit works in an area with particularly difficult socio-economic conditions, it will enjoy the policies and regimes prescribed in Decree No. 76/2019/ND-CP dated October 18, 2019 of the Government on policies for cadres, civil servants, public employees, workers and salary earners in the armed forces working in areas with particularly difficult socio-economic conditions (not entitled to the allowances prescribed in Point b of this Clause).

d) After cadres, civil servants and public employees have completed their tasks at the grassroots level, are accepted back to the agency, organization or unit where they are sent or are assigned a suitable job by a competent authority that is not lower than the job position before being transferred to the grassroots level; at the same time, enjoy the following policies:

The salary will be increased by one level (the time of maintaining the new salary level is calculated according to the time of maintaining the old salary level) if the final salary level in the rank or title has not been ranked.

The ministries, departments, branches and provinces will consider rewarding according to the provisions of the Law on Emulation and Commendation.

Thus, civil servants who increase their work trips to commune-level facilities are entitled to the above benefits.
