How is registering death for living people fined?

Clause 3, Article 41 of Decree 109/2026/ND-CP Regulating penalties for administrative violations in the field of judicial support; judicial administration; marriage and family; civil judgment enforcement; recovery, bankruptcy of enterprises, cooperatives (effective from May 18, 2026) stipulates:

A fine of between VND 10,000,000 and VND 20,000,000 shall be imposed for one of the following acts:

a) Complete procedures for registering death for living people;

b) Failure to carry out procedures for registering death for the deceased for personal gain;

c) Providing false information and documents when carrying out death registration procedures for personal gain.

Clause 4, Article 41 of Decree 109/2026/ND-CP stipulates additional penalties as follows: Confiscation of exhibits that are papers and documents that have been erased or modified to distort the content for violations specified in Clause 1 of this Article.

Clause 4, Article 4 of Decree 109/2026/ND-CP stipulates: The fine level specified in Chapters II, III, IV, V, VI and VII of this Decree is applied to administrative violations of individuals, except for Article 22 and the articles specified in Clause 5 of this Article. In case an organization has administrative violations similar to those of an individual, the fine level is equal to 02 times the fine level for an individual.

Thus, from May 18, 2026, the procedure for registering death for living people will be fined from 10,000,000 VND to 20,000,000 VND for individuals and from 20,000,000 VND to 40,000,000 VND for organizations and apply the additional penalty form mentioned above.
