Currently, the act of putting people not under the management responsibility of the organization on the list of health insurance participants violates the provisions of Article 83 of Decree 90/2026/ND-CP, effective from May 15, 2026 on sanctioning administrative violations in the field of health.
1. For acts of putting people on the list of health insurance participants not in accordance with regulations:
- In case of violation but not causing damage to the health insurance fund: fine from 1,000,000 VND to 2,000,000 VND calculated on each health card.
- In case of use in medical examination and treatment with health insurance causing damage to the health insurance fund: fine from 2,000,000 VND to 3,000,000 VND calculated on each health card.
2. For acts of participating in health insurance at agencies and organizations not in accordance with regulations:
- In case of not using a health card for medical examination and treatment with health insurance: a fine of between VND 1,000,000 and VND 2,000,000 shall be imposed on each person with a health insurance card.
- In case of using a health card for medical examination and treatment with health insurance: a fine of VND 2,000,000 to VND 3,000,000 shall be imposed on each person with a health insurance card.
3. Additional penalty form: confiscation of administrative violation exhibits, which are health insurance cards, for cases of violation.
4. Overcoming consequences: forcing the refund of the violated amount to the health insurance fund's collection account (if any).
