Lawyer Tran Phi Dai, Ho Chi Minh City Bar Association, said that to minimize damage from road traffic accidents, the Government issued Decree 279/2025/ND-CP regulating the establishment, financial sources formed, management, expenditure activities, and use of the Road Traffic Accident Damage Mitigation Fund.
According to the provisions of this Decree, families with victims who died in road traffic accidents and are facing economic difficulties are supported with no more than 20 million VND/case/family with a victim who died.
On June 30, 2026, the Ministry of Public Security issued Circular 126/2026/TT-BCA stipulating the order and procedures for implementing the content of spending from the road traffic accident damage reduction fund (effective from September 1, 2026) to guide the implementation of Decree 279/2025/ND-CP.
Accordingly, Clause 3, Article 3, Circular 126/2026/TT-BCA, stipulates that for households with victims who died in road traffic accidents and are facing economic difficulties, it is necessary to have confirmation from the commune-level People's Committee where the household resides that the household is facing economic difficulties; Documents proving that the victim died in a road traffic accident; conclusions or notices of traffic accident resolution from the Police agency (if any).
Thus, families with deaths due to road traffic accidents need to have confirmation that the household is facing economic difficulties from the commune-level People's Committee where they reside and documents proving that the victim died in a road traffic accident to receive support.
