Lawyer Nguyen Huu Hoc, Ho Chi Minh City Bar Association, said that on October 23, 2025, the Government issued Decree 279/2025/ND-CP regulating the establishment, financial sources formed, management, expenditure activities, and use of the Road Traffic Accident Damage Reduction Fund.
According to the provisions of this Decree, victims injured by traffic accidents with a injury rate of over 81% are supported for community reintegration and continued development with a maximum level of no more than 100 million VND/01 injured person/01 time.
On June 30, 2026, the Ministry of Public Security issued Circular 126/2026/TT-BCA stipulating the order and procedures for implementing the content of spending from the road traffic accident damage reduction fund (effective from September 1, 2026) to guide the implementation of Decree 279/2025/ND-CP.
Accordingly, Clause 3, Article 3, Circular 126/2026/TT-BCA, stipulates that victims injured in road traffic accidents with a body injury rate of over 81%, need to have documents to prove in accordance with the provisions of Points a and c, Clause 1 of this Article to receive support from the Road Traffic Accident Damage Reduction Fund.
Points a and c, Clause 1, Article 3, Circular 126/2026/TT-BCA of the Ministry of Public Security stipulate: For victims injured in road traffic accidents with a body injury rate of over 31% to below 81% who are facing economic difficulties, including:
a) Documents proving the body injury rate of the victim according to the provisions of law; conclusions or notices of traffic accident resolution from the Police agency (if any);
c) Documents and invoices collecting money for injury assessment costs of victims injured in road traffic accidents according to the provisions of Clause 6, Article 11, Decree No. 279/2025/ND-CP (if any).
Thus, victims injured in road traffic accidents with a body injury rate of over 81%, need to have documents to prove according to the above regulations to receive maximum support of 100 million VND from the Road Traffic Accident Damage Reduction Fund.
