Article 17 of Decree 46/2026/ND-CP detailing the implementation of a number of articles and measures to organize and guide the implementation of the Law on Food Safety (effective from January 26, 2026) stipulates the responsibility of establishments not subject to the Certificate of eligibility for food safety as follows:
1. The following establishments are not eligible for the Certificate of eligibility for food safety:
a) Small-scale initial production;
b) Producing and trading food without fixed locations;
c) Minor preliminary processing;
d) Small-scale food business;
e) Business of pre-packaged foods, food additives, food processing aids, micronutrients;
e) Production and trading of tools, packaging materials, and food containers;
g) Restaurants in hotels, tourist apartment complexes, tourist villa complexes;
h) Collective kitchens without registration of food business lines;
i) Street food business;
2. Facilities specified in Clause 1 of this Article must comply with the requirements for corresponding food safety assurance conditions.
Thus, from January 26, 2026, street food businesses are not eligible for a certificate of eligibility for food safety.
