The Government has issued Decree 106/2025/ND-CP detailing the handling of administrative violations in the fields of fire prevention, fire fighting and rescue. The Decree takes effect from July 1, 2025.
Compared to the previous regulations, Decree 106 has increased the maximum fine for some serious acts, with the risk of directly causing fire or explosion or not ensuring conditions for detection, organization of fire fighting, rescue when incidents occur, easily leading to widespread fire and large fire causing damage to people and property.
Some adjusted fines are as follows:
Violations in the use of fire sources, heat sources, equipment, fire-ghosting tools, and thermogenesis (Article 11) can be fined up to VND 25 million (previously VND 15 million).
Violations in equipment, installation, use, and maintenance of fire prevention and fighting and rescue equipment and equipment (Articles 20, 22) can be subject to a maximum fine of VND 50 million (previously VND 25 million).
Violations in establishing and maintaining the Fire Prevention and Rescue Team at facilities and specialized levels (Article 8) may be subject to a maximum fine of VND 30 million (previously VND 15 million).
Violations related to escape routes (Article 24, etc.) can be fined up to VND 50 million (previously VND 25 million).
The act of not self-checking fire safety was also subject to a maximum fine of VND20 million (previously VND5 million).
For acts that are not the direct cause of fires and explosions, the agency drafting the Decree only slightly raises the fine for these acts.
According to the drafting agency, the increase in fines is to enhance legal effectiveness, raise awareness and responsibility of organizations and individuals, especially heads of establishments in fire prevention, fire fighting and rescue work. Thereby, contributing to reducing violations, preventing fires and explosions, ensuring safety of people and property, maintaining security and social order.
