Clause 8, Article 1 of the Law amending and supplementing a number of articles of the Law on Judicial Records in 2025 (effective from July 1, 2026) stipulates the amendment and supplementation of Article 15 of the Law on Judicial Records in 2009, stipulating that judicial record information on criminal record is established from the following sources:

1. Criminal first-instance judgments that have taken legal effect and appellate criminal judgments;

2. Decisions of cassation and reopening review on criminal matters; decisions of suspending appellate trial; decisions of releasing defendants; decisions of summarizing penalties;

3. Decision on criminal judgment enforcement;

4. Decisions to postpone, temporarily suspend the execution of prison sentences, conditional parole; decisions to cancel decisions to postpone, temporarily suspend the execution of prison sentences, conditional parole; decisions to exempt from serving penalties; decisions to exempt from serving sentences, reduce the duration of serving sentences; decisions to shorten the probation period for people with suspended sentences, people with conditional parole; decisions to force people with suspended sentences to serve prison sentences; decisions to extend the deportation period;

5. Decisions on exemption and reduction of judgment enforcement obligations for state budget revenues;

6. Certificate of completion of sentence execution; document notifying the results of execution of deportation penalty;

7. Decision to enforce the penalty, confiscate property, court fees and other civil obligations of the convicted person; certificate of judgment enforcement results; written notice of termination of judgment enforcement in cases where the convicted person has completed their obligations;

8. Decision to suspend judgment enforcement;

9. Decision on reduction of the death penalty; decision to convert the death penalty to life imprisonment;

10. Certificate of special amnesty, great amnesty;

11. Decision to remove criminal record;

12. Extracts of judgments or extracts of criminal records of Vietnamese citizens provided by competent foreign agencies to the Supreme People's Procuracy under international treaties on judicial assistance in the criminal field or under the principle of reciprocity;

13. Documents of Vietnamese competent authorities sent to foreign agencies requesting extradition for criminal prosecution and judgment enforcement; extradition decisions of foreign competent authorities; documents on receiving and escorting exiled people from abroad to Vietnam; notices of decisions on exemption, reduction of sentences, amnesty, and extermination of the transferring country for people serving prison sentences;

14. Decisions to execute extradition decisions, decisions to transfer people serving prison sentences in Vietnam at the request of competent foreign agencies;

15. Other valuable documents and materials proving information about the criminal record of the individual.

Thus, from July 1, 2026, judicial record information about criminal records will be taken from the above source.
