Clause 2, Article 4, Section 1, Chapter II of Decree No. 120/2013/ND-CP stipulating administrative sanctions in the field of national defense and cryptography is amended by Clause 7, Article 1 of Decree No. 37/2022/ND-CP stipulating violations of regulations on military service registration as follows:
2. A fine of from VND 8,000,000 to VND 10,000,000 shall be imposed for one of the following acts:
a) Not registering for military service for the first time, except for the case specified in Clause 1 of this Article;
b) Failure to register for reserve service as prescribed;
c) Failure to register for additional military service when there is a change in job position, educational level, professional qualifications, health status and other information related to military service as prescribed;
d) Failure to register for military service when changing residence or place of work or study as prescribed;
d) Failure to register for temporary military service as prescribed.
Clause 2, Article 3 of Decree No. 120/2013/ND-CP, amended by Clause 6, Article 1 of Decree No. 37/2022/ND-CP, stipulates the level of fines for individuals, organizations and the authority to impose fines as follows:
2. The fines for administrative violations specified in Sections 1, 2, 3, 5, 6, 7 and 8, Chapter II; Section 1, Chapter III of this Decree shall be applied to administrative violations by individuals; except for violations specified in Article 9; Clause 3, Article 11; Clause 2, Clause 3, Article 12; Clause 1, Clause 2, Article 15; Article 16; Article 17 and Article 21, which are fines applicable to organizations. In case an organization commits the same violation as an individual, the fine shall be twice the fine for an individual.
Thus, failure to register for military service when changing residence or place of work or study can result in a fine of VND 8 million to VND 10 million.
