On the morning of November 9, authorized by the Prime Minister, Mr. Dao Ngoc Dung - Minister of Labor, War Invalids and Social Affairs reported on the draft Law on Employment (amended).
According to Mr. Dao Ngoc Dung, absorbing the opinions of the National Assembly Standing Committee and the review opinions of the Social Committee, the draft Law was absorbed, reviewed, revised and restructured to include 9 chapters and 94 articles.
Regarding the group of unemployment insurance policies stipulated in the draft, Mr. Dao Ngoc Dung said that this is a tool to manage the labor market through amending unemployment insurance regimes in the direction of focusing on effectively supporting unemployed workers, promoting the responsibility of enterprises in training, fostering, and improving vocational skills to maintain employment for workers.
Along with that, support training, improve skills, increase counseling, job referrals, help unemployed people return to the labor market soon, at the same time create favorable conditions for workers to receive unemployment benefits and prescribe measures to fundamentally overcome the situation of fraud and policy exploitation as in the recent past.
One of the issues that many people are concerned about is the unemployment benefit level stipulated in the draft Law on Employment (amended).
According to the latest draft of the Law on Employment (amended) submitted to the National Assembly, the monthly unemployment benefit is equal to 60% of the average monthly salary for unemployment insurance contributions of the 6 most recent months of unemployment insurance contributions before unemployment, but not exceeding 5 times the regional minimum monthly salary announced by the Government in the last month of unemployment insurance contributions.
The period of unemployment benefits is calculated based on the number of months of unemployment insurance contributions. For every 12 months of contributions up to 36 months, you will receive 3 months of unemployment benefits. After that, for every additional 12 months of contributions, you will receive 1 more month of unemployment benefits, but not exceeding 12 months.
Regarding this content, at a workshop to collect opinions on the draft Law on Employment (amended) organized by the Vietnam General Confederation of Labor, Mr. Nguyen Thai Duong - Vice President of the Vietnam Textile and Garment Trade Union - said that many workers in the textile and garment industry believe that the 60% rate is very low and may not be able to ensure their minimum living standards.
Regarding this content, the Vietnam General Confederation of Labor requested the drafting unit of the revised Law on Employment to study and adjust the monthly unemployment benefit level to 75% of the average monthly salary for unemployment insurance payment most recently before unemployment.
The reason given by the Vietnam General Confederation of Labor is that, in reality, most businesses pay unemployment insurance for employees according to the regional minimum wage set by the Government, while the current regional minimum wage is still low.
According to the Union, it is appropriate to increase unemployment benefits to at least 75% (equal to the maximum pension level) to create conditions to support workers to have a minimum living standard when they lose their jobs or become unemployed.
