Clause 1, Article 3 of Decree 137/2020/ND-CP of the Government on management and use of fireworks stipulates:
1. Fireworks are products containing gunpowder, when impacted by mechanical, thermal, chemical or electrical stimuli, causing a rapid, strong, gaseous chemical reaction, creating sound, light and color effects in space, causing an explosion or not causing an explosion.
Fireworks include: Firecrackers, fireworks.
a) Fireworks are products that are manufactured, handcrafted or industrially produced, which, when subjected to mechanical, thermal, chemical or electrical stimulation, cause an explosion or cause a hissing, popping sound and color effects in space;
Fireworks that cause hissing, banging and colorful effects in space are called explosive fireworks;
Low-altitude fireworks are fireworks with a diameter not greater than 90 mm or a firing range not exceeding 120 m. High-altitude fireworks are fireworks with a diameter over 90 mm or a firing range over 120 m;
b) Fireworks are products that are manufactured, handcrafted or industrially produced, which, when impacted by mechanical, thermal, chemical or electrical stimulation, create sound, light and color effects in space, without causing an explosion.
According to Article 11 of Decree No. 137/2020/ND-CP, fireworks used by the State are fired on major holidays of the year such as Lunar New Year, Hung Kings' Commemoration Day, and National Day.
Article 17 of Decree No. 137/2020/ND-CP stipulates the use of fireworks as follows:
1. Agencies, organizations and individuals with full civil act capacity are allowed to use fireworks in the following cases: Festivals, New Year's, birthdays, weddings, conferences, openings, anniversaries and in cultural and artistic activities.
2. Agencies, organizations and individuals using fireworks may only purchase fireworks from organizations and businesses licensed to produce and trade fireworks.
Thus, people can only use fireworks (purchased from organizations and businesses licensed to produce and trade) during the 2025 Lunar New Year.
