Advertising insulting personal honor and dignity fined up to 120 million VND

Clause 4, Article 50 of Decree No. 87/2026/ND-CP stipulates penalties for administrative violations in the field of culture and advertising (effective from May 15, 2026):

4. A fine of 40 million VND to 60 million VND shall be imposed for one of the following acts:

a) Advertising that insults the prestige, honor, and dignity of organizations and individuals;

b) Advertising comparing its products, goods, and services with similar products, goods, and services of other organizations and individuals but without legal documents to prove it;

c) Advertising with actions, words, images, sounds, and writing that create thoughts, words, and actions against morality and fine customs for children; causing adverse effects on children's health, safety, or normal development;

d) Advertising contrary to historical, cultural, and social ethics traditions;

d) Advertising films through film introductions or information related to the film before, during the production, distribution and dissemination of films violating the provisions of Article 9 of the Cinema Law No. 05/2022/QH15.

Point b, Clause 7, Article 50 of Decree No. 87/2026/ND-CP stipulates remedial measures as follows: Forced to apologize in writing to organizations and individuals for the acts specified in point a, Clause 4 of this Article;

Clause 2, 3, Article 6 of Decree No. 87/2026/ND-CP stipulates:

2. The penalty level specified in Chapter II and Chapter III of this Decree is the penalty level applied to individuals, except for cases specified in Clauses 2, 5, 6 and 7 of Article 15; Clauses 4, 5, 6 and 7 of Article 16; Clauses 1, 2, 3, 4 and point b of Clause 5 of Article 33; Clauses 1, 2, 3, 4 and point b of Clause 5 of Article 34; Clauses 1, 2, 3, 4 and point a of Clause 5 of Article 35; Articles 57, 58 and 59 of this Decree is the penalty level applied to organizations.

3. For the same administrative violation, the fine for organizations is 2 times the fine for individuals.

Thus, from May 15, 2026, advertising that insults the prestige, honor, and dignity of organizations and individuals may be fined from 40 million VND to 60 million VND and from 80 million VND to 120 million VND for organizations and forced to apologize to organizations and individuals in writing according to the above regulations.
