With 453/461 National Assembly deputies present in agreement (reaching 98%), on the morning of June 16, the National Assembly voted to pass the Law amending and supplementing a number of articles of the Law on Advertising.
The Law amends and supplements a number of articles of the Advertising Law, including 3 articles, stipulating that the Government unifies state management of advertising activities; the Government assigns ministries and ministerial-level agencies to preside over and coordinate the implementation of state management responsibilities for advertising activities.
People's Committees at all levels shall exercise state management of advertising activities within their local authority.

The draft Law has just been passed, amending and supplementing Article 23 on online advertising.
Accordingly, online advertising activities include: Advertising in electronic newspapers, electronic information pages, social networks, online applications, digital platforms with Internet connection.
Online advertising activities must comply with regulations such as having clear identification signs with numbers, letters, symbols, images, and sounds to distinguish advertising content from other non-advertising content.
For advertisements not in a fixed area, there must be recognizable features and symbols that allow the advertiser to turn off the advertisement, notify the service provider of violating advertising content, and refuse to view inappropriate advertising content.
For advertisements containing links to other content, the content of the links must comply with the provisions of law; advertising service business people, advertising publishers have solutions to check and supervise the content of the links...
In addition, current law clearly stipulates that content not advertised on electronic information pages, social networks, online applications, and digital platforms violates the law.
The implementation of the above regulation is being implemented quite effectively to overcome the situation of brand safety when Vietnamese brands are attached to inappropriate content and fake news to sabotage the Party and the State.

Reporting on receiving, explaining, revising, and drafting the Law, Chairman of the Committee for Culture and Society Nguyen Dac Vinh said that regarding the rights and obligations of those who transmit advertising products, there were opinions suggesting considering regulations on the obligation to " Provide documents related to advertising content when requested by a competent state agency".
There are also opinions suggesting adding the obligation for those who transmit advertising products to be jointly responsible for compensation for untrue advertising behavior.
Regarding the above contents, the National Assembly Standing Committee stated that entities participating in advertising activities must be responsible for providing information when requested by competent state agencies, including those who transfer advertising products.
Regarding the responsibility for joint compensation, to advertise a product, there are many entities participating. Each subject is responsible for fully fulfilling its obligations. When there are violations, depending on the nature and severity of the violation, they will have to be handled accordingly.
Therefore, the National Assembly Standing Committee proposes to keep the regulation as in the draft Law.
The Law amending and supplementing a number of articles of the Law on Advertising takes effect from January 1, 2026.
