Authority to decide on the sale of public assets of public service units

The Lao Dong Newspaper Legal Consulting Office replied:

Clause 2, Article 58 of Decree 186/2025/ND-CP (effective from July 1, 2025) stipulates the authority to decide on the sale of public assets of public service units as follows:

a) Ministers and heads of central agencies decide or delegate authority to decide on the sale of assets with a price of VND 250 million or more 01 unit of assets and assets with a revaluation value of VND 50 million or more 01 unit of assets at public service units under the management of ministries and central agencies, except for the cases specified in Point d of this Clause.

b) The Chairman of the Provincial People's Committee decides or decentralizes the authority to decide on the sale of assets with a price of VND 250 million or more/01 unit of assets and assets with a value of VND 50 million or more 01 unit of assets at public service units under the management of the locality, except for the case specified in Point d of this Clause.

c) Public service units with public assets, except for the cases specified in Point d of this Clause, decide to sell for:

Assets with an original value of VND 250 million or more/01 unit of assets, assets with a revaluation value of VND 50 million or more 01 unit of assets under the authority of the Minister, Head of the Central agency, Chairman of the Provincial People's Committee decentralized;

Assets with an estimated value of less than VND 250 million/01 unit of assets, assets with a revaluation value of less than VND 50 million/01 unit of assets.

d) Public service units self-insure regular expenditures and investment expenditures to decide on the sale of public assets at their units.

Thus, the authority to decide on the sale of public assets of public service units is prescribed as above.
