Instructions on the principles of arranging public service units

The arrangement of public service units after the merger is directed to be carried out carefully, maintaining stability, especially in the fields of education and health.

The Steering Committee for the arrangement of administrative units at all levels and the development of a model of organizing local government at both levels of the Government has issued many specific and detailed guiding documents for localities to have a basis for implementation related to public service units.

Document No. 68/CV-BCD clearly states that public service units in the education and health sectors will be kept stable in the locality, only arranged when absolutely necessary and will not affect the operation of serving the essential needs of local people.

At the same time, maintain educational institutions; for district health centers transferred to the Department of Health for management; maintain commune health stations under current health centers or arrange health stations at the old commune level into 1 health station at the new commune level and health points in old communes to serve people

Regarding public service units in the fields of Agriculture and Environment; Science and Technology, and other economic activities, units will be streamlined, assigned to the provincial level for management and a network system for providing public service services according to the inter-commune area, in accordance with the specific conditions of each locality.

Regarding public service units under the fields of project management, land fund development, site clearance, market and bus station management, localities, based on conditions, characteristics and capability to ensure self-balancing revenue from public service service provision activities to establish public service units at the provincial level (with inter-commune facilities) or commune level.

Arrange with the condition of ensuring that public service units when established will ensure regular expenditure and perform the function of providing public service in these areas in the area.

Regarding the establishment of a new public service unit in the area, the authority is considered by the Provincial People's Committee to consider the necessity and decide to establish it on the basis of the general project of the arrangement of commune-level administrative units according to Decree No. 120/2020/ND-CP on the establishment, reorganization, and dissolvement of public service units.

Mr. Phan Trung Tuan - Director of the Department of Local Government, Ministry of Home Affairs commented that some localities are still facing difficulties in implementing regulations related to the authority to establish professional agencies and other administrative organizations at the commune level; public service units at the commune level; or the authority to appoint, dismiss, or remove from the positions of heads and deputy heads of public service units.

Mr. Tuan analyzed that the main reason is the lack of consistency between the provisions of the Law on Organization of Local Government and the Government's decrees on decentralization, delegation of authority and determination of authority.

On this issue, Mr. Tuan said that the Ministry of Home Affairs is coordinating with ministries and branches to have specific instructions.
