Fine 115 million VND
On December 24, 2024, during a check of construction order in the area, the People's Committee of Ward 4, Tan An City discovered Mr. Vo Tan Khanh (residing in Hamlet 4, Huong Tho Phu Commune, Tan An City, Long An Province) organizing the construction of a pickleball sports house with a total construction area of up to 1,823.6m2 on a number of plots of land, part of which was built on agricultural land.
The project was discovered to be built on plots of land No. 563 and 564, map sheet No. 2-4, urban residential land type (ODT), and part of plot No. 307, map sheet No. 2-4, land for other annual crops (BHK). The construction area on agricultural land is 216m2.
Through comparison, Mr. Khanh was only granted a Construction Permit No. 565/GPXD by the People's Committee of Tan An City on September 23, 2024 for a single-family house with a construction area of 345m2 at plots 563 and 564. Therefore, the construction as is is not in accordance with the actual construction.
On December 24, 2024, the People's Committee of Ward 4 made a record of administrative violations, transferred the dossier to the Chairman of Tan An People's Committee to sanction. Three days later, Chairman of the City People's Committee. Tan An issued Decision No. 3837 to sanction administrative sanctions against Mr. Vo Tan Khanh with a total amount of VND 115 million for two violations. In particular, a fine of 65 million VND for acts of construction of unauthorized works for the type of works required to make economic and technical reports on construction investment; A fine of VND 50 million for acts of arbitrarily converting agricultural land to residential land in contravention of regulations.
In addition to the form of fines, the decision also applies measures to stop the construction of the project, asking Mr. Vo Tan Khanh within 90 days from the date of issuing the decision to complete the dossier of application for construction permits and dismantling the violating works if not licensed. In case of failure, the authorities will conduct coercion in accordance with the law.
In addition, Mr. Khanh was also forced to restore the original state of the agricultural land before the violation.
Repeatedly requesting to remedy the consequences of violations
On January 15, 2025, Mr. Vo Tan Khanh imposed a fine in cash. On March 19, 2025, Mr. Vo Tan Khanh submitted a request to extend the remedial period to 90 days (from March 27, 2025 to June 27, 2025) to have enough time to carry out procedures for land use conversion, request a construction permit according to regulations, with the reason being to prepare documents for land conversion procedures in accordance with regulations and apply for a construction permit for the above project.
On March 25, 2025, the People's Committee of Ward 4 continued to invite Mr. Vo Tan Khanh to work and request the implementation of Decision No. 3837/QD-UBND dated December 27, 2024 of the Chairman of the City People's Committee and requested the urgent implementation of legal procedures related to changing land use purposes, applying for a new construction permit or applying for a construction permit adjustment in accordance with regulations.
However, up to now, Mr. Vo Tan Khanh has not yet implemented and fully presented the requirements to ensure compliance with regulations.
In addition, Mr. Vo Tan Khanh has not voluntarily demolished the violating construction. The People's Committee of Ward 4 consolidated the dossier to propose that the Chairman of the People's Committee of Tan An City consider issuing a decision to enforce the implementation of remedial measures against Mr. Vo Tan Khanh in accordance with the provisions of law.
According to Mr. Vo Hong Thao - Chairman of the People's Committee of Tan An City - over the past time, the People's Committee of Ward 4 has repeatedly invited Mr. Khanh to work, requesting the compliance with the sanctioning decision and completing the legal procedures. After the extension of the extension, if Mr. Vo Tan Khanh still fails to produce the appropriate license and fails to dismantle the violating works by himself, the People's Committee of Ward 4 will consolidate the proposal of Chairman of the People's Committee of Tan An City to issue a decision to enforce and ensure strictness in the management of construction order and land use in accordance with the law.
