Ministry of Home Affairs responds to recommendation that people enjoying social insurance benefits must verify their conditions annually

The Ministry of Home Affairs has responded to the recommendation requiring people enjoying social insurance benefits to verify information that meets the conditions for enjoyment annually.

The Ministry of Home Affairs received opinions, received and explained comments and social criticisms on the draft Law amending and supplementing a number of articles of the Law on Social Insurance (BHXH) No. 41/2024/QH15 of the Ministry of Finance, Ho Chi Minh City Department of Home Affairs, Lao Cai province, Quang Ninh, Quang Ninh Provincial National Assembly Delegation, Ho Chi Minh City National Assembly Delegation.

One of the contents contributed by the above agencies, localities, and units is to propose that the drafting agency study and supplement regulations amending and supplementing point c, clause 2, Article 11 of the Law on Social Insurance No. 41/2025/QH15 as follows: "Periodiquely every year, social insurance beneficiaries are responsible for coordinating with the social insurance agency or service organization authorized by the social insurance agency to verify information that meets the conditions for enjoying social insurance benefits".

The reason for the proposal is to create synchronization and unity in management, verifying beneficiaries and having a mechanism to temporarily suspend benefits for all cases where information cannot be verified, regardless of the method of receiving money in cash or through bank accounts.

With the amendment of this regulation, it has covered the regulation of temporary suspension for cash beneficiaries who have not been verified for beneficiary information for many years, as well as solved the current practical problems because the accumulated amount of money received from many years is still printed on the payment list, easily leading to losses if negativity occurs.

Responding to the above content, the Ministry of Home Affairs did not accept it, because the addition of the above regulations increased the responsibility of participants and beneficiaries.

Currently, with the interconnection and sharing between databases, it has created favorable conditions for social insurance agencies in controlling social insurance benefits, especially those who directly enjoy social insurance benefits from social insurance agencies and service agencies authorized by social insurance.

According to the provisions of Article 93 of the Law on Social Insurance, there are 3 forms of pension and social insurance regime payment including: Through the beneficiary's account; directly from the social insurance agency or service organization authorized by the social insurance agency or through the employer.

Therefore, for social insurance beneficiaries who receive directly from social insurance agencies or service organizations authorized by social insurance, the social insurance agency and the service agency authorized by social insurance must be responsible for verifying the information of beneficiaries.
