Mr. Phan Van Hung (name of the character changed) said that he signed a labor contract with the Geotechnical Center in 2006 when he had intermediate qualifications. In April 2019, this unit merged into the land registration office, and in October 2019, he was transferred to work at the branch of the land registration office.
According to Mr. Hung, in December 2025, after graduating from university, he submitted his degree to the agency. In January 2026, the unit prepared a submission to the provincial land registration office requesting a salary grade transfer, but so far there has been no decision.
In April 2026, Mr. Hung passed the civil servant recruitment and was notified of a salary coefficient of 2.34, and must also implement a 1-year internship regime.
Mr. Hung wondered whether the salary ranking as above is in accordance with regulations, while he has worked for more than 19 years and participated in social insurance (BHXH). He requested competent authorities to consider and answer to ensure his rights according to regulations.
Regarding Mr. Hung's proposal, the Ministry of Home Affairs has responded on the Electronic Information Portal.
Salary ranking for people recruited and received as public employees from December 7, 2023 is regulated in Article 4, Circular No. 05/2024/TTBNV dated June 27, 2024 of the Minister of Home Affairs.
In case there is a working period belonging to the subjects receiving salary with compulsory social insurance contributions in accordance with the law and not belonging to the subjects specified in Clause 1, Clause 2 of this Article, salary ranking and determination of equivalent time holding the rank of appointed public employee when recruiting and receiving are carried out as follows:
Regarding salary ranking: Based on the total time of receiving salary with compulsory social insurance contributions (if there is non-continuous time but there is no one-time social insurance benefit, it is accumulated) minus probationary time calculated according to the regulations of the professional title appointed when recruiting and receiving, the remaining time is used as a basis for salary ranking in the professional title recruited and received as follows:
Calculated from level 1 of the professional title of civil servant appointed when recruiting and receiving, after each period of 3 years (enough 36 months) for cases appointed to the title of civil servant ranked as salary type A0, type A1 or after each period of 2 years (enough 24 months) for cases appointed to the title of civil servant ranked as salary type B, it is ranked up to 1 salary level.
After converting the time to be ranked into the salary grade in the professional title appointed when recruiting and receiving as mentioned above, if there are months that are not enough 36 months (for civil servants ranked as type A0, type A1) or not enough 24 months (for civil servants ranked as type B), these months are counted into the time for considering salary grade promotion next time or considering enjoying seniority allowance beyond the frame (if any) in the title appointed when recruiting and receiving.
Based on the above regulations and the functions, tasks, and powers of the People's Committees of provinces and centrally-run cities, the tasks and powers of public non-business units specified in Article 65 and Article 66 of Decree No. 115/2020/ND-CP dated September 25, 2020 of the Government (amended and supplemented in Decree No. 85/2023/ND-CP dated December 7, 2023 of the Government), the Ministry of Home Affairs requests you to exchange with the management agency of civil servants where you work for consideration, guidance, and resolution.
