Sending a question to the Ministry of Home Affairs, reader Nguyen Thi Minh Phuong (character name has been changed - PV) said: An official holding the position of head of department (term of appointment August 1, 2023 - July 30, 2028), a type 4 public service unit of the state that ensures regular expenditures, is entitled to a position allowance of 0.3.
In July 2025, the unit was merged into another unit (the type did not change, but there was no head of department), this official was no longer the head of department, only a supporting official.
I would like to ask, when will the above-mentioned public employee enjoy the position allowance? According to the example in Official Dispatch No. 16/CV-BCĐ dated August 9, 2025, this position allowance is not mentioned, so is it understood as not enjoying the position allowance?
Article 11 of Decree No. 178/2024/ND-CP mentions leadership position allowances, so can Article 11 of Decree No. 178/2024/ND-CP be applied in the above case, is it allowed to be reserved until the end of the appointment period? " - the reader asked.
Regarding this issue, the Ministry of Home Affairs answers as follows:
On December 31, 2024, the Government issued Decree No. 178/2024/ND-CP (amended and supplemented in Decree No. 67/2025/ND-CP), in which Article 11 stipulates:
Cadres, civil servants, and public employees who cease to hold leadership and management positions or are elected and appointed to leadership and management positions with a lower position salary or position allowance due to organizational restructuring, will have their old position salary or old leadership position allowance preserved until the end of the election term or the expiration of the appointment term. In case they have held leadership and management positions according to the election term or the appointment term is less than 06 months, they are preserved for 06 months".
Based on the above regulations, the Ministry of Home Affairs requests citizens to contact the agency managing cadres, civil servants, and public employees (Department of Home Affairs) for answers.
