The Government has just issued Decree No. 93/2026/ND-CP detailing and guiding the implementation of a number of articles of the Law on Teachers.
This Decree consists of 7 chapters, 26 articles, detailing and guiding the implementation of a number of articles of the Law on Teachers on teacher titles, appointment, change of teacher titles; recruitment, reception of teachers; transfer, transfer, inter-school, inter-level teaching, evaluation for teachers; policies to attract and value teachers, retirement regime at a higher age for teachers; standard training level of teachers, training, and fostering for teachers.
Article 13 of the Decree details the regime of salaries and allowances for teachers when teaching at inter-schools and inter-levels; principles, authority and order of assignment of teachers to teach at inter-schools and inter-levels.
Assignment must be based on the actual conditions of teachers
According to regulations, inter-school and inter-level teaching is not carried out mechanically but must consider geographical factors, the personal circumstances of teachers, and there must be consensus between the management unit and the receiving place. This is to limit the situation of assignment causing overload or irrationality for teachers.
Relevant educational institutions are also responsible for coordinating and arranging appropriate time and tasks so that teachers can complete teaching in many places and at many levels of education.
Clear and competent assignment process
For schools under local management, the assignment must be developed into a plan, agreed upon between schools and submitted to the Commune People's Committee or the Department of Education and Training for decision.
For higher education and vocational education institutions with many affiliated units, the head of the institution will decide or authorize assignment, based on proposals from member units.
Notably, each assignment decision must clearly state the time, teaching volume, coordination responsibilities between the parties and be updated in the teacher's electronic records.
Calculating teaching hours together, without "loss"
An important point is that the total number of teaching hours of teachers will be calculated together from all assigned places. This ensures that teachers are not disadvantaged in terms of labor norms when having to teach in many schools and levels.
Teacher evaluation is still directly carried out by the management unit, but must be based on additional comments from the place where the teacher is assigned to teach. This approach helps to reflect the actual quality more accurately.
Salary paid by one unit, with additional support regimes
Salaries and salaries according to salaries of teachers teaching at inter-schools and inter-levels are paid by the main management unit.
Meanwhile, overtime allowances (if any), mobile allowances and other expenses are implemented according to current regulations and are guaranteed by the state budget.
