According to the new Circular, the form of people's supervision of police forces on duty through audio and video recording is eliminated.

Removed many public contents

The Ministry of Public Security has just issued a Circular amending and supplementing a number of articles of Circular No. 67/2019/TT-BCA, regulating the implementation of democracy in ensuring traffic order and safety. The Circular takes effect from November 15, 2024.

In the new circular, the Ministry of Public Security has removed some content that is no longer suitable to reality, causing many problems.

Accordingly, in the work of patrolling, controlling and handling administrative violations, remove the public content: "Plan for general control of traffic vehicles, Plan for patrolling, controlling and handling violations by traffic topic, Plan for regular patrolling, controlling and handling violations (remove point d, clause 1, Article 5 of Circular No. 67/2019)".

At the same time, amend Point c, Clause 1, Article 5 to "Technical means and equipment to detect administrative violations according to the provisions of the Law on Handling of Administrative Violations".

Compared to previous regulations, the content of publicizing "uniforms and police numbers" has been removed.

In the work of vehicle registration and license plate issuance, remove the public content: "Uniform, People's Public Security number of officers in charge of vehicle registration and license plate issuance (remove point c, clause 2, Article 5 of Circular No. 67/2019)".

In the work of commanding and controlling traffic, the task force removed the public content: "Uniforms, People's Public Security numbers and technical means and support tools are made public according to regulations (abolish point b, clause 3, Article 5 of Circular No. 67/2019)".

Eliminate regulations on audio and video recording of police on duty

Article 11 of the new Circular stipulates the form of people's supervision in ensuring traffic order and safety, including:

Access to public information of the police force and on mass media; Through monitoring entities as prescribed by law; Direct contact and resolution of work with officers and soldiers; Results of resolution of cases, petitions, complaints, denunciations, recommendations, and reflections; Direct observation of work to ensure traffic order and safety.

Thus, in the new Circular, the form of monitoring through recording and video recording devices in the old Circular has been eliminated.

At the same time, the new Circular also stipulates that people's supervision must ensure the following conditions: Not affecting the activities of officers and soldiers while performing official duties; Not being allowed to enter the area of ​​official duty specified in Clause 2, Article 4 of this Circular, except for people with related rights and obligations; Complying with other relevant legal provisions.

According to the Ministry of Public Security, in recent times, people's supervision of the traffic police force has sometimes been inconsistent with regulations; taking advantage of the right to supervise to film, record and share on social networks, leading to a fear of collision and a lack of responsibility among some officers and soldiers directly performing their duties, affecting the image of the traffic police force;

The opposition took advantage of the situation to incite people to send complaints and denunciations to many places, causing complications for law enforcement regarding traffic order and safety... Awareness and understanding of citizens' responsibilities when participating in traffic are not adequate...
