Regarding the proposal to reduce social insurance contributions by less than 15 years to receive a pension, the Ministry of Home Affairs believes that there needs to be time to assess the impact before considering adjustments.

The 2025 Law on Social Insurance (BHXH) has stipulated a reduction in the minimum social insurance contribution period to enjoy the retirement regime (pension) from 20 years to 15 years.

This is to create opportunities for older workers with low social insurance participation years to access and enjoy social insurance benefits.

Accordingly, employees who reach retirement age and have paid social insurance for 15 years or more are entitled to a monthly pension.

Contributing opinions to the draft Law on Social Insurance (amended), Lang Son Provincial People's Committee proposed that the drafting agency continue to study the roadmap to shorten the minimum social insurance contribution period to receive a pension (under 15 years), in order to create conditions for late participants to have the opportunity to receive a pension.

Responding to this proposal, the Ministry of Home Affairs emphasized that the adjustment to reduce the number of years of social insurance contribution to receive pensions needs to be considered and evaluated with the ability to balance the Social Insurance Fund.

At the same time, the adjustment of the minimum social insurance contribution period has just been reduced from 20 years to 15 years. Therefore, it is necessary to have time to assess the impacts on the fund's balance capacity.

Regarding the regulation on pension benefits, the Cao Bang Department of Home Affairs proposed to study and adjust the regulation on the formula for calculating the percentage of pension benefits, in the direction of ensuring fairness and appropriateness for beneficiaries.

According to the Cao Bang Department of Home Affairs, the purpose of the policy is to promote the restriction of enjoying one-time social insurance benefits, creating motivation for long-term, stable, and equal social insurance participants between men and women, and between groups of subjects.

For example, stipulate the benefit rate divided according to the participating time milestones, such as from 10 years to less than 15 years, from 15 years to less than 20 years, from 20 years to less than 30 years, from 30 years or more... The principle is that the higher the contribution time milestone, the higher the accumulation rate is added.

Amending the pension rate calculation method is also a suggestion from the Lam Dong Provincial People's Committee. This is to encourage workers to continue participating in social insurance for a longer time, reducing pressure on the Social Insurance Fund. At the same time, helping workers receive higher pensions and ensure their lives.

According to the People's Committee of Dien Bien province, the current Law on Social Insurance stipulates that the monthly pension benefit rate for female workers is 45%, corresponding to 15 years of social insurance contributions; male workers is 45%, corresponding to 20 years of contributions, which does not really ensure the principle of equality and proportionality between contribution level and benefit level.

Therefore, this unit proposes to study and amend it in the direction of applying a unified pension benefit calculation formula between male and female workers, ensuring the principle of contribution - benefit, creating motivation for workers to participate in long-term and stable social insurance.

In the report on receiving and explaining the draft revised Law on Social Insurance, the Ministry of Home Affairs said that the change in the pension calculation rate has a great impact on employees. Therefore, it is necessary to study and evaluate carefully.
