Sending a question to the Social Insurance agency, reader D.H.N said: "I am a non-specialized commune-level official, contributing to social insurance for 1 year. New regulations on social insurance for non-specialized officials contributing to the maternity fund from July 1, 2025.
Please ask, am I entitled to maternity benefits if I give birth in September 2025?".
Regarding this issue, Vinh Long Provincial Social Insurance answers as follows:
According to the provisions of point k, clause 1, Article 2, point a, clause 1, Article 33, clause 1, Article 34 of the 2024 Law on Social Insurance (effective from July 1, 2025), non-specialized workers at the commune, village, and residential group levels pay social insurance specifically as follows:
Employers and employees monthly pay compulsory social insurance calculated on the salary used as the basis for compulsory social insurance contributions of subjects specified in the Law on Social Insurance: 3% to the sickness and maternity fund; 22% to the pension and survivorship fund (of which employees contribute 8%).
According to the provisions of Clause 2, Article 50 of the 2024 Law on Social Insurance, subjects specified in Points b, c, d and d, Clause 1, Article 50 of the 2024 Law on Social Insurance must pay compulsory social insurance for 6 months or more in the 12 consecutive months before giving birth or receiving children when using surrogacy or adopting children under 6 months old.
Thus, based on the above regulations, Ms. D.H.N does not meet the conditions to enjoy maternity benefits because she has not paid for 6 months or more within the 12 months immediately preceding childbirth (fee for sickness and maternity).
Because the 2024 Law on Social Insurance takes effect from July 1, 2025, non-specialized workers have regulations on contributing to the sickness and maternity fund (before July 1, 2025, only 22% were contributed to the pension and survivorship fund).
